| 7 | 7 | | relating to the security of the electric grid. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter Z, Chapter 39, Utilities Code, is |
|---|
| 10 | 10 | | amended by adding Section 39.917 to read as follows: |
|---|
| 11 | 11 | | Sec. 39.917. GRID SECURITY COUNCIL. (a) The governor shall |
|---|
| 12 | 12 | | appoint members of the grid security council. Council membership |
|---|
| 13 | 13 | | must include at least one representative of each of the following: |
|---|
| 14 | 14 | | (1) the commission; |
|---|
| 15 | 15 | | (2) the independent organization certified under |
|---|
| 16 | 16 | | Section 39.151 for the ERCOT power region; |
|---|
| 17 | 17 | | (3) the Texas Military Department; |
|---|
| 18 | 18 | | (4) the Texas Division of Emergency Management; |
|---|
| 19 | 19 | | (5) the State Office of Risk Management; and |
|---|
| 20 | 20 | | (6) power generation companies. |
|---|
| 21 | 21 | | (b) The council shall monitor economic, environmental, |
|---|
| 22 | 22 | | regulatory, and technological developments that may affect the |
|---|
| 23 | 23 | | security of the electric grid. |
|---|
| 24 | 24 | | (c) Not later than the November 1 preceding each regular |
|---|
| 25 | 25 | | session of the legislature, the council shall prepare and submit a |
|---|
| 26 | 26 | | report to the legislature analyzing: |
|---|
| 27 | 27 | | (1) the developments listed in Subsection (b); and |
|---|
| 28 | 28 | | (2) the progress made towards implementing the |
|---|
| 29 | 29 | | council's previous grid security recommendations. |
|---|
| 30 | 30 | | (d) The governor shall designate a member of the council to |
|---|
| 31 | 31 | | serve as presiding officer. |
|---|
| 32 | 32 | | (e) A member of the council is not entitled to compensation. |
|---|
| 33 | 33 | | SECTION 2. (a) The grid security council shall evaluate |
|---|
| 34 | 34 | | security vulnerabilities of the electric grid and strategies for |
|---|
| 35 | 35 | | securing the grid against: |
|---|
| 36 | 36 | | (1) cyber threats; |
|---|
| 37 | 37 | | (2) physical threats; |
|---|
| 38 | 38 | | (3) weather threats; |
|---|
| 39 | 39 | | (4) solar storm threats; |
|---|
| 40 | 40 | | (5) threats of sabotage; and |
|---|
| 41 | 41 | | (6) threats relating to electromagnetic pulses. |
|---|
| 42 | 42 | | (b) Not later than November 1, 2020, the council shall |
|---|
| 43 | 43 | | prepare and submit a report to the legislature with recommendations |
|---|
| 44 | 44 | | for addressing the threats identified in Subsection (a) of this |
|---|
| 45 | 45 | | section. The council's report shall include recommendations for: |
|---|
| 46 | 46 | | (1) state agency rule changes; |
|---|
| 47 | 47 | | (2) legislation; and |
|---|
| 48 | 48 | | (3) management changes at the Public Utility |
|---|
| 49 | 49 | | Commission of Texas, the Texas Military Department, the Texas |
|---|
| 50 | 50 | | Division of Emergency Management, and the State Office of Risk |
|---|
| 51 | 51 | | Management. |
|---|
| 52 | 52 | | SECTION 3. The first report described by Section 39.917(c), |
|---|
| 53 | 53 | | Utilities Code, as added by this Act, is due November 1, 2022. |
|---|
| 54 | 54 | | SECTION 4. This Act takes effect September 1, 2019. |
