77 relating to the security of the electric grid.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter Z, Chapter 39, Utilities Code, is
1010 amended by adding Section 39.917 to read as follows:
1111 Sec. 39.917. GRID SECURITY COUNCIL. (a) The governor shall
1212 appoint members of the grid security council. Council membership
1313 must include at least one representative of each of the following:
1414 (1) the commission;
1515 (2) the independent organization certified under
1616 Section 39.151 for the ERCOT power region;
1717 (3) the Texas Military Department;
1818 (4) the Texas Division of Emergency Management;
1919 (5) the State Office of Risk Management; and
2020 (6) power generation companies.
2121 (b) The council shall monitor economic, environmental,
2222 regulatory, and technological developments that may affect the
2323 security of the electric grid.
2424 (c) Not later than the November 1 preceding each regular
2525 session of the legislature, the council shall prepare and submit a
2626 report to the legislature analyzing:
2727 (1) the developments listed in Subsection (b); and
2828 (2) the progress made towards implementing the
2929 council's previous grid security recommendations.
3030 (d) The governor shall designate a member of the council to
3131 serve as presiding officer.
3232 (e) A member of the council is not entitled to compensation.
3333 SECTION 2. (a) The grid security council shall evaluate
3434 security vulnerabilities of the electric grid and strategies for
3535 securing the grid against:
3636 (1) cyber threats;
3737 (2) physical threats;
3838 (3) weather threats;
3939 (4) solar storm threats;
4040 (5) threats of sabotage; and
4141 (6) threats relating to electromagnetic pulses.
4242 (b) Not later than November 1, 2020, the council shall
4343 prepare and submit a report to the legislature with recommendations
4444 for addressing the threats identified in Subsection (a) of this
4545 section. The council's report shall include recommendations for:
4646 (1) state agency rule changes;
4747 (2) legislation; and
4848 (3) management changes at the Public Utility
4949 Commission of Texas, the Texas Military Department, the Texas
5050 Division of Emergency Management, and the State Office of Risk
5151 Management.
5252 SECTION 3. The first report described by Section 39.917(c),
5353 Utilities Code, as added by this Act, is due November 1, 2022.
5454 SECTION 4. This Act takes effect September 1, 2019.
