119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12- SECTION 1. STUDY OF IMPACT OF FEDERAL EDUCATIONAL MANDATES
13- ON SCHOOL DISTRICTS. (a) In this section, "federal educational
14- mandate" means a federal statutory provision or a rule or
15- regulation adopted under that provision the implementation of which
16- requires an expenditure by a school district that would not have
17- been required in the absence of the statutory provision or the rule
18- or regulation adopted under that provision.
10+ SECTION 1. STUDY OF IMPACT OF STATE EDUCATIONAL MANDATES ON
11+ SCHOOL DISTRICTS. (a) In this section, "state educational mandate"
12+ means a statutory provision or a Texas Education Agency rule
13+ adopted under that provision the implementation of which requires
14+ an expenditure by a school district that would not have been
15+ required in the absence of the statutory provision or the rule
16+ adopted under that provision.
1917 (b) The Legislative Budget Board, in coordination with the
2018 Texas Education Agency, shall conduct a study regarding the effect
21- of federal educational mandates on school districts. The study
22- must include:
19+ of state educational mandates on school districts. The study must
20+ include:
2321 (1) a cost-benefit analysis on the impact of school
24- district compliance with federal educational mandates, including a
22+ district compliance with state educational mandates, including a
2523 comparison of:
2624 (A) the direct and indirect costs incurred by a
27- school district in complying with a federal educational mandate;
28- and
25+ school district in complying with a state educational mandate; and
2926 (B) the amount of funds received by the district
30- or state from the federal government to comply with the mandate;
31- (2) a list of all federal educational mandates for
32- which the federal government has not provided full payment or
33- reimbursement that results in expenditures accrued by a school
34- district or the state to comply with the federal educational
35- mandate; and
36- (3) recommendations to reduce the burden of federal
37- educational mandates on school districts.

3835 SECTION 2. REPORT. Not later than December 31, 2020, the
3936 Legislative Budget Board shall deliver a report of the board's
4037 findings and recommendations to the legislature.
4138 SECTION 3. EXPIRATION. This Act expires February 1, 2021.
4239 SECTION 4. EFFECTIVE DATE. This Act takes effect
4340 immediately if it receives a vote of two-thirds of all the members
4441 elected to each house, as provided by Section 39, Article III, Texas
4542 Constitution. If this Act does not receive the vote necessary for
4643 immediate effect, this Act takes effect September 1, 2019.
