66 AN ACT
77 relating to the issuance of a permit by the Public Utility
88 Commission of Texas for the routing of certain oil or gas pipelines;
99 authorizing administrative penalties.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. The Utilities Code is amended by adding Title 6
1212 to read as follows:
1313 TITLE 6. PIPELINE REGULATION
1414 CHAPTER 601. OIL OR GAS PIPELINE ROUTE PERMITS
1515 Sec. 601.0101. DEFINITION. In this chapter, "commission"
1616 means the Public Utility Commission of Texas.
1717 Sec. 601.0102. APPLICABILITY. (a) This chapter applies
1818 only to a pipeline that transports gas or petroleum and is owned,
1919 operated, or managed by:
2020 (1) a gas corporation, as defined by Chapter 181; or
2121 (2) a common carrier subject to Chapter 111, Natural
2222 Resources Code.
2323 (b) This chapter does not apply to a pipeline:
2424 (1) the routing of which is subject solely to the
2525 jurisdiction of a federal agency;
2626 (2) that is a gas distribution pipeline facility; or
2727 (3) that is a sour gas pipeline facility, as defined by
2828 Section 121.451.
2929 Sec. 601.0103. ROUTE PERMIT; MANDAMUS. (a) A person may
3030 not begin construction of a pipeline before the person obtains from
3131 the commission a permit that authorizes the route of the pipeline.
3232 (b) The commission may approve an application and grant a
3333 permit only if the commission determines that the route of the
3434 pipeline, if reasonable, moderates negative effects on the affected
3535 community and landowners after consideration of:
3636 (1) community values;
3737 (2) recreational and park areas;
3838 (3) historical and aesthetic values; and
3939 (4) environmental integrity.
4040 (c) The commission may:
4141 (1) grant the permit as requested;
4242 (2) grant the permit for the construction of a portion
4343 of the requested pipeline; or
4444 (3) deny the permit.
4545 (d) The commission must grant or deny a permit not later
4646 than the first anniversary of the date the application for the
4747 permit is filed. If the commission does not grant or deny the
4848 permit on or before that date, a party may seek a writ of mandamus in
4949 a district court of Travis County to compel the commission to take
5050 action under Subsection (c).
5151 Sec. 601.0104. ENFORCEMENT AND PENALTIES. (a) The
5252 commission and the attorney general may enforce the provisions of
5353 this chapter in the manner authorized for the judicial or
5454 administrative enforcement of a provision of Title 2 by Subchapter
5555 B, Chapter 15, including by imposing administrative penalties.
5656 (b) A person may complain to the commission about a claimed
5757 violation of a provision of this chapter in the manner provided by
5858 Section 15.051.
5959 SECTION 2. This Act takes effect September 1, 2019.
