117 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12- SECTION 1. Section 1305.101(a), Occupations Code, is
13- amended to read as follows:
14- (a) The executive director or commission, as appropriate,
15- shall:
16- (1) by rule establish the financial responsibility
17- requirements for electrical contractors; [and]
18- (2) after publication of the National Electrical Code
19- by the National Fire Protection Association every three years,
20- adopt the revised National Electrical Code as the electrical code
21- for the state; and
22- (3) after publication of the National Electrical
23- Safety Code by the Institute of Electrical and Electronics
24- Engineers every five years, adopt the revised National Electrical
25- Safety Code for purposes of Section 1305.162(e).
26- SECTION 2. Section 1305.162(e), Occupations Code, is
27- amended to read as follows:
28- (e) Notwithstanding Subsection (b), an examination required
29- for a license as:
30- (1) a journeyman industrial electrician under Section
31- 1305.1601 may only test an applicant regarding activities performed
32- by a journeyman industrial electrician at a location described by
33- Section 1305.002(11-b); and
34- (2) a journeyman lineman under Section 1305.1605 may
8+ SECTION 1. Section 1305.162, Occupations Code, is amended
9+ by adding Subsection (f) to read as follows:
10+ (f) Notwithstanding Subsection (b), an examination required
11+ for a license as a journeyman lineman under Section 1305.1605 may
3512 only test an applicant regarding activities performed by a
36- journeyman lineman as described by the National Electrical Safety
37- Code as adopted under Section 1305.101(a).
38- SECTION 3. Section 1305.162(e)(2), Occupations Code, as
39- added by this Act, applies only to an examination for a journeyman
40- lineman license administered on or after June 1, 2020. An
41- examination for a journeyman lineman license administered before
42- that date is governed by the law in effect on the date the
43- examination was administered, and the former law is continued in
44- effect for that purpose.
45- SECTION 4. Not later than March 1, 2020, the Texas
46- Commission of Licensing and Regulation shall adopt rules necessary
47- to implement Sections 1305.101(a)(3) and 1305.162(e)(2),
48- Occupations Code, as added by this Act.
49- SECTION 5. This Act takes effect September 1, 2019.

15+ adopted by the commission.
16+ SECTION 2. As soon as practical, the Texas Commission of
17+ Licensing and Regulation shall adopt rules as required by Section
18+ 1305.102, Occupations Code, as amended by this Act.
19+ SECTION 3. Section 1305.162(f), Occupations Code, as added
20+ by this Act, applies only to an examination for a journeyman lineman
21+ license administered on or after June 1, 2020. An examination for a
22+ journeyman lineman license administered before that date is
23+ governed by the law and rules in effect prior to the date this Act
24+ was enacted, and the former law is continued in effect for that
25+ purpose.
26+ SECTION 4. This Act takes effect September 1, 2019.
