55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the licensing and regulation of school psychologists.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 501.002, Occupations Code, is amended by
1010 adding Subdivision (6) to read as follows:
1111 (6) "School psychologist" means a person who holds a
1212 license to engage in the practice of psychology under Section
1313 501.260.
1414 SECTION 2. Section 501.051(a-1), Occupations Code, is
1515 amended to read as follows:
1616 (a-1) One of the members appointed under Subsection (a)(1)
1717 or (a)(2) must practice as a [licensed specialist in] school
1818 psychologist [psychology under Section 501.260].
1919 SECTION 3. The heading to Section 501.260, Occupations
2020 Code, is amended to read as follows:
2121 Sec. 501.260. [LICENSED SPECIALIST IN] SCHOOL PSYCHOLOGIST
2222 [PSYCHOLOGY].
2323 SECTION 4. Section 501.260, Occupations Code, is amended by
2424 amending Subsections (a) and (c) and adding Subsection (d) to read
2525 as follows:
2626 (a) The board by rule shall issue a license to a [licensed
2727 specialist in] school psychologist [psychology]. A license issued
2828 under this section constitutes the appropriate credential for a
2929 person who provides psychological services as required by Section
3030 21.003(b), Education Code.
3131 (c) The rules of practice for a [licensed specialist in]
3232 school psychologist [psychology] must comply with nationally
3333 recognized standards for the practice of school psychology.
3434 (d) A person may not use the title "school psychologist"
3535 unless the person holds a license issued under this section.
3636 SECTION 5. Section 501.002(2), Occupations Code, is
3737 repealed.
3838 SECTION 6. Section 501.260(d), Occupations Code, as added
3939 by this Act, applies only to conduct that occurs on or after the
4040 effective date of this Act. Conduct that occurs before the
4141 effective date of this Act is governed by the law in effect on the
4242 date the conduct occurred, and the former law is continued in effect
4343 for that purpose.
4444 SECTION 7. This Act takes effect September 1, 2019.
