| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 501.002, Occupations Code, is amended by |
|---|
| 10 | 10 | | adding Subdivision (6) to read as follows: |
|---|
| 11 | 11 | | (6) "School psychologist" means a person who holds a |
|---|
| 12 | 12 | | license to engage in the practice of psychology under Section |
|---|
| 13 | 13 | | 501.260. |
|---|
| 14 | 14 | | SECTION 2. Section 501.051(a-1), Occupations Code, is |
|---|
| 15 | 15 | | amended to read as follows: |
|---|
| 16 | 16 | | (a-1) One of the members appointed under Subsection (a)(1) |
|---|
| 17 | 17 | | or (a)(2) must practice as a [licensed specialist in] school |
|---|
| 18 | 18 | | psychologist [psychology under Section 501.260]. |
|---|
| 19 | 19 | | SECTION 3. The heading to Section 501.260, Occupations |
|---|
| 20 | 20 | | Code, is amended to read as follows: |
|---|
| 21 | 21 | | Sec. 501.260. [LICENSED SPECIALIST IN] SCHOOL PSYCHOLOGIST |
|---|
| 22 | 22 | | [PSYCHOLOGY]. |
|---|
| 23 | 23 | | SECTION 4. Section 501.260, Occupations Code, is amended by |
|---|
| 24 | 24 | | amending Subsections (a) and (c) and adding Subsection (d) to read |
|---|
| 25 | 25 | | as follows: |
|---|
| 26 | 26 | | (a) The board by rule shall issue a license to a [licensed |
|---|
| 27 | 27 | | specialist in] school psychologist [psychology]. A license issued |
|---|
| 28 | 28 | | under this section constitutes the appropriate credential for a |
|---|
| 29 | 29 | | person who provides psychological services as required by Section |
|---|
| 30 | 30 | | 21.003(b), Education Code. |
|---|
| 31 | 31 | | (c) The rules of practice for a [licensed specialist in] |
|---|
| 32 | 32 | | school psychologist [psychology] must comply with nationally |
|---|
| 33 | 33 | | recognized standards for the practice of school psychology. |
|---|
| 34 | 34 | | (d) A person may not use the title "school psychologist" |
|---|
| 35 | 35 | | unless the person holds a license issued under this section. |
|---|
| 36 | 36 | | SECTION 5. Section 501.002(2), Occupations Code, is |
|---|
| 37 | 37 | | repealed. |
|---|
| 38 | 38 | | SECTION 6. Section 501.260(d), Occupations Code, as added |
|---|
| 39 | 39 | | by this Act, applies only to conduct that occurs on or after the |
|---|
| 40 | 40 | | effective date of this Act. Conduct that occurs before the |
|---|
| 41 | 41 | | effective date of this Act is governed by the law in effect on the |
|---|
| 42 | 42 | | date the conduct occurred, and the former law is continued in effect |
|---|
| 43 | 43 | | for that purpose. |
|---|
| 44 | 44 | | SECTION 7. This Act takes effect September 1, 2019. |
