| 10 | 10 | is amended by adding Section 75.008 to read as follows: | |
| 11 | 11 | Sec. 75.008. LIABILITY LIMITED FOR LATE FEES COLLECTED BY A | |
| 12 | 12 | LANDLORD. | |
| 13 | 13 | (a) A landlord is not liable for damages related to the | |
| 14 | 14 | collection of a late fee from a tenant for the tenant's failure to | |
| 15 | 15 | pay any portion of delinquent rent unless the late fee exceeds the | |
| 16 | 16 | greater of $150 or ten percent of the amount of rent for the rental | |
| 17 | 17 | pay period under the lease. | |
| 18 | 18 | (b) The calculation of the fee under subsection (a) shall | |
| 19 | 19 | include any direct or indirect costs or damages associated with the | |
| 20 | 20 | landlord's collection of delinquent rent. | |
| 21 | 21 | SECTION 2. This Act takes effect September 1, 2019. |
