66 AN ACT
77 relating to demonstration projects to coordinate eligibility
88 renewal and eligibility recertification for certain children in the
99 Medicaid and child health plan programs.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 62, Health and Safety
1212 Code, is amended by adding Section 62.1025 to read as follows:
1313 Sec. 62.1025. ELIGIBILITY RENEWAL DEMONSTRATION PROJECT.
1414 (a) The commission shall establish a demonstration project through
1515 the child health plan program to allow the commission to
1616 simultaneously renew the eligibility of each child residing in the
1717 same household who is eligible for enrollment in the program.
1818 (b) The executive commissioner shall adopt rules necessary
1919 to determine the scope of and eligibility for participating in the
2020 demonstration project.
2121 (c) The commission shall, to the extent possible, operate
2222 the demonstration project established under this section in
2323 conjunction with the demonstration project established under
2424 Section 32.02614, Human Resources Code. The demonstration project
2525 may not increase the frequency with which:
2626 (1) the eligibility of children participating in the
2727 demonstration project would otherwise be renewed; or
2828 (2) those children's household incomes are reviewed
2929 under Section 62.102(b).
3030 (d) Not later than December 1, 2022, the commission shall
3131 submit a report to the legislature regarding the commission's
3232 progress in establishing and operating the demonstration project
3333 and recommendations on continuing or expanding the demonstration
3434 project.
3535 (e) This section expires September 1, 2023.
3636 SECTION 2. Subchapter B, Chapter 32, Human Resources Code,
3737 is amended by adding Section 32.02614 to read as follows:
3838 Sec. 32.02614. ELIGIBILITY RECERTIFICATION DEMONSTRATION
3939 PROJECT. (a) In this section, "child health plan program" has the
4040 meaning assigned by Section 531.001, Government Code.
4141 (b) The commission shall establish a demonstration project
4242 through the medical assistance program to allow the commission, to
4343 the greatest extent possible, to develop and test solutions to
4444 simultaneously:
4545 (1) recertify and renew, as applicable, the
4646 eligibility of each child residing in the same household who is
4747 eligible for medical assistance under this chapter or for the child
4848 health plan program, including the eligibility of siblings when a
4949 child within the household reaches the age of one; and
5050 (2) verify the household income of all persons
5151 described by Subdivision (1) in accordance with this section to
5252 determine eligibility.
5353 (c) The demonstration project must include participation by
5454 one or more households in each of the following categories:
5555 (1) a household with children who are eligible for
5656 medical assistance or the child health plan program, at least one of
5757 whom is younger than the age of one;
5858 (2) a household with children who are eligible for
5959 medical assistance or the child health plan program, at least some
6060 of whom are not siblings; and
6161 (3) a household with at least one child who is eligible
6262 for medical assistance and at least one child who is eligible for
6363 the child health plan program.
6464 (d) The commission shall simultaneously verify the
6565 household income of all children within the same household
6666 participating in the demonstration project not more frequently than
6767 three times during each 12-month period. To the extent
6868 practicable:
6969 (1) the first verification must occur before the
7070 fourth month following the earliest date that a child residing in
7171 the household was determined to be eligible for the medical
7272 assistance program;
7373 (2) the second verification must occur after the
7474 four-month period but before the eighth month following the
7575 earliest date that a child residing in the household was determined
7676 to be eligible for the medical assistance program; and
7777 (3) the third verification must occur after the
7878 eight-month period but before the annual recertification date.
7979 (e) The executive commissioner shall adopt rules necessary
8080 to determine the scope of and eligibility for participating in the
8181 demonstration project.
8282 (f) The commission may establish the demonstration project
8383 in one or more geographic areas in this state and form partnerships
8484 with entities experienced in outreach, application assistance, and
8585 enrolling recipients in the medical assistance program, the child
8686 health plan program, and any other health benefits coverage.
8787 (g) The commission shall, to the extent possible, operate
8888 the demonstration project established under this section in
8989 conjunction with the demonstration project established under
9090 Section 62.1025, Health and Safety Code.
9191 (h) Not later than December 1, 2022, the commission shall
9292 submit a report to the legislature regarding the commission's
9393 progress in establishing and operating the demonstration project
9494 and recommendations on continuing or expanding the demonstration
9595 project.
9696 (i) This section expires September 1, 2023.
9797 SECTION 3. Not later than September 1, 2020, the Health and
9898 Human Services Commission shall implement the eligibility renewal
9999 and eligibility recertification demonstration projects required by
100100 Section 62.1025, Health and Safety Code, as added by this Act, and
101101 Section 32.02614, Human Resources Code, as added by this Act.
102102 SECTION 4. If before implementing any provision of this Act
103103 a state agency determines that a waiver or authorization from a
104104 federal agency is necessary for implementation of that provision,
105105 the agency affected by the provision shall request the waiver or
106106 authorization and may delay implementing that provision until the
107107 waiver or authorization is granted.
108108 SECTION 5. This Act takes effect immediately if it receives
109109 a vote of two-thirds of all the members elected to each house, as
110110 provided by Section 39, Article III, Texas Constitution. If this
111111 Act does not receive the vote necessary for immediate effect, this
112112 Act takes effect September 1, 2019.
