| 7 | 7 | | relating to the compensation of an assistant county auditor. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 84.021, Local Government Code, is |
|---|
| 10 | 10 | | amended by amending Subsections (a) and (b) and adding Subsection |
|---|
| 11 | 11 | | (b-1) to read as follows: |
|---|
| 12 | 12 | | (a) From time to time the county auditor may certify to the |
|---|
| 13 | 13 | | district judges a list stating the number of assistants to be |
|---|
| 14 | 14 | | appointed and[,] the name, duties, qualifications, and experience |
|---|
| 15 | 15 | | of each appointee[, and the salary to be paid each appointee]. The |
|---|
| 16 | 16 | | district judges, after careful consideration of the application for |
|---|
| 17 | 17 | | the appointment of the assistants and after inquiry concerning the |
|---|
| 18 | 18 | | appointees' qualifications and[,] the positions sought to be |
|---|
| 19 | 19 | | filled, [and the reasonableness of the requested salaries,] shall |
|---|
| 20 | 20 | | prepare a list of the appointees that the judges approve [and the |
|---|
| 21 | 21 | | salary to be paid each]. The judges shall certify this list to the |
|---|
| 22 | 22 | | commissioners court, which shall order [the] salaries to be paid on |
|---|
| 23 | 23 | | the performance of services and shall appropriate an adequate |
|---|
| 24 | 24 | | amount of money for this purpose. |
|---|
| 25 | 25 | | (b) If an emergency exists, the county auditor shall |
|---|
| 26 | 26 | | recommend the appointment of temporary assistants, and [after a |
|---|
| 27 | 27 | | hearing held in accordance with Section 152.905,] the district |
|---|
| 28 | 28 | | judges shall determine the number[, salaries,] and duration of |
|---|
| 29 | 29 | | employment of the assistants. |
|---|
| 30 | 30 | | (b-1) The commissioners court shall determine the salary of |
|---|
| 31 | 31 | | an assistant auditor appointed under Subsection (a) or (b). |
|---|
| 32 | 32 | | SECTION 2. Sections 152.905(a), (b), and (d), Local |
|---|
| 33 | 33 | | Government Code, are amended to read as follows: |
|---|
| 34 | 34 | | (a) This section applies only to the compensation of the |
|---|
| 35 | 35 | | county auditor[, assistant auditors,] and court reporters. |
|---|
| 36 | 36 | | (b) Before setting the amount of annual compensation of the |
|---|
| 37 | 37 | | county auditor[, assistant auditors,] and court reporters, the |
|---|
| 38 | 38 | | district judge or judges shall hold a public hearing on the matter |
|---|
| 39 | 39 | | at which parties in interest and citizens have an opportunity to be |
|---|
| 40 | 40 | | heard. |
|---|
| 41 | 41 | | (d) At the hearing, the district judge or judges shall set |
|---|
| 42 | 42 | | the amount of compensation of the county auditor[, assistant |
|---|
| 43 | 43 | | auditors,] and court reporters considered at the hearing. The vote |
|---|
| 44 | 44 | | must be recorded, transcribed, and maintained as a public record. |
|---|
| 45 | 45 | | SECTION 3. The changes in law made by this Act apply only to |
|---|
| 46 | 46 | | an assistant county auditor appointed on or after the effective |
|---|
| 47 | 47 | | date of this Act. An assistant county auditor appointed before the |
|---|
| 48 | 48 | | effective date of this Act is governed by the law in effect |
|---|
| 49 | 49 | | immediately before the effective date of this Act, and that law is |
|---|
| 50 | 50 | | continued in effect for that purpose. |
|---|
| 51 | 51 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 52 | 52 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 53 | 53 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 54 | 54 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 55 | 55 | | Act takes effect September 1, 2019. |
