55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the compensation of an assistant county auditor.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 84.021, Local Government Code, is
1010 amended by amending Subsections (a) and (b) and adding Subsection
1111 (b-1) to read as follows:
1212 (a) From time to time the county auditor may certify to the
1313 district judges a list stating the number of assistants to be
1414 appointed and[,] the name, duties, qualifications, and experience
1515 of each appointee[, and the salary to be paid each appointee]. The
1616 district judges, after careful consideration of the application for
1717 the appointment of the assistants and after inquiry concerning the
1818 appointees' qualifications and[,] the positions sought to be
1919 filled, [and the reasonableness of the requested salaries,] shall
2020 prepare a list of the appointees that the judges approve [and the
2121 salary to be paid each]. The judges shall certify this list to the
2222 commissioners court, which shall order [the] salaries to be paid on
2323 the performance of services and shall appropriate an adequate
2424 amount of money for this purpose.
2525 (b) If an emergency exists, the county auditor shall
2626 recommend the appointment of temporary assistants, and [after a
2727 hearing held in accordance with Section 152.905,] the district
2828 judges shall determine the number[, salaries,] and duration of
2929 employment of the assistants.
3030 (b-1) The commissioners court shall determine the salary of
3131 an assistant auditor appointed under Subsection (a) or (b).
3232 SECTION 2. Sections 152.905(a), (b), and (d), Local
3333 Government Code, are amended to read as follows:
3434 (a) This section applies only to the compensation of the
3535 county auditor[, assistant auditors,] and court reporters.
3636 (b) Before setting the amount of annual compensation of the
3737 county auditor[, assistant auditors,] and court reporters, the
3838 district judge or judges shall hold a public hearing on the matter
3939 at which parties in interest and citizens have an opportunity to be
4040 heard.
4141 (d) At the hearing, the district judge or judges shall set
4242 the amount of compensation of the county auditor[, assistant
4343 auditors,] and court reporters considered at the hearing. The vote
4444 must be recorded, transcribed, and maintained as a public record.
4545 SECTION 3. The changes in law made by this Act apply only to
4646 an assistant county auditor appointed on or after the effective
4747 date of this Act. An assistant county auditor appointed before the
4848 effective date of this Act is governed by the law in effect
4949 immediately before the effective date of this Act, and that law is
5050 continued in effect for that purpose.
5151 SECTION 4. This Act takes effect immediately if it receives
5252 a vote of two-thirds of all the members elected to each house, as
5353 provided by Section 39, Article III, Texas Constitution. If this
5454 Act does not receive the vote necessary for immediate effect, this
5555 Act takes effect September 1, 2019.
