66 AN ACT
77 relating to the state contributions to the Teacher Retirement
88 System of Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 825.404, Government Code, is amended by
1111 amending Subsections (a) and (a-1) and adding Subsection (a-2) to
1212 read as follows:
1313 (a) Except as provided by Subsection (a-1) and subject to
1414 Subsection (a-2), during each fiscal year, the state shall
1515 contribute to the retirement system an amount equal to at least six
1616 and not more than 10 percent of the aggregate annual compensation of
1717 all members of the retirement system during that fiscal year.
1818 (a-1) In computing the amount owed by the state under this
1919 section [Subsection (a)], the compensation of members who are
2020 employed by public junior colleges or public junior college
2121 districts shall be included in the aggregate annual compensation as
2222 follows:
2323 (1) 50 percent of the eligible creditable compensation
2424 of employees who:
2525 (A) otherwise are eligible for membership in the
2626 retirement system; and
2727 (B) are instructional or administrative
2828 employees whose salaries may be fully paid from funds appropriated
2929 under the General Appropriations Act, regardless of whether such
3030 salaries are actually paid from appropriated funds; and
3131 (2) none of the eligible creditable compensation of
3232 all other employees who:
3333 (A) do not meet the requirements of Subdivision
3434 (1)(B) but are otherwise eligible for membership in the retirement
3535 system; or
3636 (B) cannot be included as a qualifying employee
3737 under Subdivision (1) by application of Subsection (b-1).
3838 (a-2) The state contribution required by Subsection (a) is:
3939 (1) for the fiscal year beginning on September 1,
4040 2019, seven percent of the aggregate annual compensation of all
4141 members of the retirement system during that fiscal year;
4242 (2) for the fiscal year beginning on September 1,
4343 2020, 7.2 percent of the aggregate annual compensation of all
4444 members of the retirement system during that fiscal year;
4545 (3) for the fiscal year beginning on September 1,
4646 2021, 7.4 percent of the aggregate annual compensation of all
4747 members of the retirement system during that fiscal year;
4848 (4) for the fiscal year beginning on September 1,
4949 2022, 7.6 percent of the aggregate annual compensation of all
5050 members of the retirement system during that fiscal year;
5151 (5) for the fiscal year beginning on September 1,
5252 2023, 7.8 percent of the aggregate annual compensation of all
5353 members of the retirement system during that fiscal year; and
5454 (6) for the fiscal year beginning on September 1,
5555 2024, and each subsequent fiscal year, eight percent of the
5656 aggregate annual compensation of all members of the retirement
5757 system during that fiscal year.
5858 SECTION 2. This Act takes effect September 1, 2019.
