| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter A, Chapter 38, Education Code, is | |
| 11 | 11 | amended by adding Section 38.039 to read as follows: | |
| 12 | 12 | Sec. 38.039. INCLUSIVE AND ACCESSIBLE PLAYGROUNDS. From | |
| 13 | 13 | funds appropriated for the purpose or any other available funds, | |
| 14 | 14 | the commissioner shall distribute funds to each school district to | |
| 15 | 15 | provide at least one playground in the district that is inclusive | |
| 16 | 16 | and accessible for students with disabilities. | |
| 17 | 17 | SECTION 2. This Act applies beginning with the 2019-2020 | |
| 18 | 18 | school year. | |
| 19 | 19 | SECTION 3. This Act takes effect immediately if it receives | |
| 20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
| 21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
| 22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
| 23 | 23 | Act takes effect September 1, 2019. |
