77 relating to fees charged to a school district by a water supply or
88 sewer service corporation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 67, Water Code, is amended by adding
1111 Section 67.0115 to read as follows:
1212 Sec. 67.0115. LIMITATION ON FEES FOR SCHOOL DISTRICTS. (a)
1313 In this section, "impact fee" means a charge imposed by a
1414 corporation against new development to pay for capital improvements
1515 or facility expansions necessitated by the new development. The
1616 term includes amortized charges, lump-sum charges, capital
1717 recovery fees, contributions in aid of construction, and any other
1818 fee that functions as described by this definition.
1919 (b) A corporation may not charge a school district an impact
2020 fee or a fee to acquire water rights unless the board of trustees of
2121 the district enters into a contract with the corporation for
2222 payment of the fees. The contract may contain terms the board of
2323 trustees considers advisable to provide for payment of the fees.
2424 SECTION 2. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2019.
