| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 43.007, Election Code, is amended by | |
| 11 | 11 | adding Subsection (a-1) and amending Subsection (k) to read as | |
| 12 | 12 | follows: | |
| 13 | 13 | (a-1) This section applies only to a county with a | |
| 14 | 14 | population of less than 400,000. | |
| 15 | 15 | (k) Each county that previously participated in a program | |
| 16 | 16 | under this section is authorized to continue participation in the | |
| 17 | 17 | program for future elections described by Subsection (a) if: | |
| 18 | 18 | (1) the commissioners court of the county approves | |
| 19 | 19 | participation in the program; [and] | |
| 20 | 20 | (2) the secretary of state determines the county's | |
| 21 | 21 | participation in the program was successful; and | |
| 22 | 22 | (3) the county has a population of less than 400,000. | |
| 23 | 23 | SECTION 2. This Act takes effect September 1, 2019. |
