9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 361.119, Health and Safety Code, is | |
11 | 11 | amended by adding Subsection (a-1) to read as follows: | |
12 | 12 | (a-1) The commission may not exempt from permit or | |
13 | 13 | registration requirements under this chapter a solid waste facility | |
14 | 14 | that: | |
15 | 15 | (1) receives more than 50 percent of its recyclable | |
16 | 16 | material directly from any combination of: | |
17 | 17 | (A) generators not affiliated with the facility; | |
18 | 18 | (B) the public; or | |
19 | 19 | (C) haulers not affiliated with the facility; | |
20 | 20 | (2) receives no financial compensation to accept any | |
21 | 21 | of the recyclable material it receives; and | |
22 | 22 | (3) shows that the material is potentially recyclable | |
23 | 23 | and has an economically feasible means of being recycled. | |
24 | 24 | SECTION 2. As soon as practicable after the effective date | |
25 | 25 | of this Act, the Texas Commission on Environmental Quality shall | |
26 | 26 | adopt rules necessary to implement Section 361.119(a-1), Health and | |
27 | 27 | Safety Code, as added by this Act. | |
28 | 28 | SECTION 3. This Act takes effect September 1, 2019. |
