| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 33.007, Utilities Code, is amended as |
|---|
| 10 | 10 | | follows: |
|---|
| 11 | 11 | | Sec. 33.007. ALLOWABLE CHARGES. (a) A municipality that |
|---|
| 12 | 12 | | performs a regulatory function under this title may make each |
|---|
| 13 | 13 | | charge that is authorized by: |
|---|
| 14 | 14 | | (1) this title; or |
|---|
| 15 | 15 | | (2) the applicable franchise agreement. |
|---|
| 16 | 16 | | (b) A county that provides use of easement or right of way |
|---|
| 17 | 17 | | under this title shall make a charge to be paid by the electric |
|---|
| 18 | 18 | | utility for such use. The charge shall be authorized by an |
|---|
| 19 | 19 | | applicable interlocal agreement between the county and electric |
|---|
| 20 | 20 | | utility. The county may withhold easement or right of way access |
|---|
| 21 | 21 | | until such an interlocal agreement is approved by both parties. |

| 22 | 22 | | SECTION 2. Section 103.0021, Utilities Code, is added as |
|---|
| 23 | 23 | | follows: |
|---|
| 24 | 24 | | Sec. 103.0021. COUNTY CHARGES. (a) A county that provides |
|---|
| 25 | 25 | | use of easement or right of way shall make a charge to be paid by the |
|---|
| 26 | 26 | | gas utility for such use. The charge shall be authorized by an |
|---|
| 27 | 27 | | applicable interlocal agreement between the county and gas utility. |
|---|
| 28 | 28 | | The county may withhold easement or right of way access until such |
|---|
| 29 | 29 | | an interlocal agreement is approved by both parties. |
|---|
| 30 | 30 | | SECTION 3. The changes in the law made by this Act apply |
|---|
| 31 | 31 | | only to payments made after the effective date of this Act. |
|---|
| 32 | 32 | | SECTION 4. This Act takes effect September 1, 2019. |
