88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 33.007, Utilities Code, is amended as
1010 follows:
1111 Sec. 33.007. ALLOWABLE CHARGES. (a) A municipality that
1212 performs a regulatory function under this title may make each
1313 charge that is authorized by:
1414 (1) this title; or
1515 (2) the applicable franchise agreement.
1616 (b) A county that provides use of easement or right of way
1717 under this title shall make a charge to be paid by the electric
1818 utility for such use. The charge shall be authorized by an
1919 applicable interlocal agreement between the county and electric
2020 utility. The county may withhold easement or right of way access
2121 until such an interlocal agreement is approved by both parties.
2222 SECTION 2. Section 103.0021, Utilities Code, is added as
2323 follows:
2424 Sec. 103.0021. COUNTY CHARGES. (a) A county that provides
2525 use of easement or right of way shall make a charge to be paid by the
2626 gas utility for such use. The charge shall be authorized by an
2727 applicable interlocal agreement between the county and gas utility.
2828 The county may withhold easement or right of way access until such
2929 an interlocal agreement is approved by both parties.
3030 SECTION 3. The changes in the law made by this Act apply
3131 only to payments made after the effective date of this Act.
3232 SECTION 4. This Act takes effect September 1, 2019.
