| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 131.014(d), Transportation Code, is | |
| 12 | 12 | amended to read as follows: | |
| 13 | 13 | (d) A corporation described by Section 131.012 may not | |
| 14 | 14 | construct [This section does not authorize the construction of] an | |
| 15 | 15 | electric railway on or across a road, street, alley, square, or | |
| 16 | 16 | property of a county or municipality unless the construction is | |
| 17 | 17 | approved by the governing body of the county or municipality, as | |
| 18 | 18 | applicable [without the consent of the governing body of the | |
| 19 | 19 | municipality]. | |
| 20 | 20 | SECTION 2. This Act takes effect immediately if it receives | |
| 21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
| 22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
| 23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
| 24 | 24 | Act takes effect September 1, 2019. |
