77 relating to a program administered by the Railroad Commission of
88 Texas to provide grants to promote pipeline emergency preparedness;
99 authorizing a fee.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 81, Natural Resources
1212 Code, is amended by adding Section 81.0715 to read as follows:
1313 Sec. 81.0715. EMERGENCY PREPAREDNESS FEES AND GRANTS. (a)
1414 The commission by rule shall establish pipeline emergency
1515 preparedness fees to be assessed for permits or registrations for
1616 pipelines under the jurisdiction of the commission's pipeline
1717 safety and regulatory program.
1818 (b) Fees collected under this section shall be deposited to
1919 the credit of a dedicated account in the general revenue fund.
2020 Money in the account may be appropriated only for the purposes of
2121 the grant program established by this section and associated
2222 administrative expenses.
2323 (c) The commission shall establish a grant program to
2424 provide funding for emergency preparedness expenses, such as the
2525 creation of evacuation plans for pipeline-related emergencies,
2626 such as spills or leaks.
2727 (d) The commission may provide a grant under this section
2828 only to a political subdivision that:
2929 (1) provides emergency services to respond to
3030 pipeline-related emergencies; and
3131 (2) is located within five miles of a pipeline.
3232 (e) The commission may establish the fees in an amount
3333 necessary to provide a reasonable amount of funding for the grant
3434 program established by this section, based on emergency
3535 preparedness expenses typically required by political subdivisions
3636 for pipeline-related emergencies.
3737 SECTION 2. This Act takes effect September 1, 2019.
