| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subchapter D, Chapter 67, Transportation Code, |
|---|
| 9 | 9 | | is amended by adding Sections 67.0611 to read as follows: |
|---|
| 10 | 10 | | Sec. 67.0611. LIMIT ON PILOTAGE RATE INCREASE. (a) In this |
|---|
| 11 | 11 | | section: |
|---|
| 12 | 12 | | (1) "Consumer price index" means the index that the |
|---|
| 13 | 13 | | comptroller considers to most accurately report changes in the |
|---|
| 14 | 14 | | purchasing power of the dollar for consumers in this state. |
|---|
| 15 | 15 | | (2) "Inflation rate" means the amount, expressed in |
|---|
| 16 | 16 | | decimal form rounded to the nearest thousandth, computed by |
|---|
| 17 | 17 | | determining the percentage change in the consumer price index for |
|---|
| 18 | 18 | | the most recent 12-month period for which the index can be |
|---|
| 19 | 19 | | determined as compared to the consumer price index for the 12-month |
|---|
| 20 | 20 | | period preceding that period. |
|---|
| 21 | 21 | | (3) "Population growth rate" means the annual rate of |
|---|
| 22 | 22 | | growth of a county's or municipality's population, as applicable, |
|---|
| 23 | 23 | | as determined in accordance with the most recent annual population |
|---|
| 24 | 24 | | estimates provided by the state demographer under Section 468.004, |
|---|
| 25 | 25 | | Government Code, expressed in decimal form rounded to the nearest |
|---|
| 26 | 26 | | thousandth. |
|---|
| 27 | 27 | | (b) By July 1 or as soon thereafter as practicable, the |
|---|
| 28 | 28 | | comptroller shall determine the inflation rate in this state and |
|---|
| 29 | 29 | | publish that rate in the Texas Register. |
|---|
| 30 | 30 | | (c) The board may not increase a pilotage rate by a rate that |
|---|
| 31 | 31 | | exceeds the sum of: |
|---|
| 32 | 32 | | (1) the inflation rate in this state; and |
|---|
| 33 | 33 | | (2) the population growth rate of Galveston County. |
|---|
| 34 | 34 | | SECTION 2. This Act takes effect September 1, 2019. |
