77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter D, Chapter 67, Transportation Code,
99 is amended by adding Sections 67.0611 to read as follows:
1010 Sec. 67.0611. LIMIT ON PILOTAGE RATE INCREASE. (a) In this
1111 section:
1212 (1) "Consumer price index" means the index that the
1313 comptroller considers to most accurately report changes in the
1414 purchasing power of the dollar for consumers in this state.
1515 (2) "Inflation rate" means the amount, expressed in
1616 decimal form rounded to the nearest thousandth, computed by
1717 determining the percentage change in the consumer price index for
1818 the most recent 12-month period for which the index can be
1919 determined as compared to the consumer price index for the 12-month
2020 period preceding that period.
2121 (3) "Population growth rate" means the annual rate of
2222 growth of a county's or municipality's population, as applicable,
2323 as determined in accordance with the most recent annual population
2424 estimates provided by the state demographer under Section 468.004,
2525 Government Code, expressed in decimal form rounded to the nearest
2626 thousandth.
2727 (b) By July 1 or as soon thereafter as practicable, the
2828 comptroller shall determine the inflation rate in this state and
2929 publish that rate in the Texas Register.
3030 (c) The board may not increase a pilotage rate by a rate that
3131 exceeds the sum of:
3232 (1) the inflation rate in this state; and
3333 (2) the population growth rate of Galveston County.
3434 SECTION 2. This Act takes effect September 1, 2019.
