66 AN ACT
77 relating to the salary paid to certain public school teachers, the
88 creation of certain teacher designations, and allotments for
99 certain educators under the Foundation School Program; authorizing
1010 the imposition of a fee.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 21, Education Code, is
1313 amended by adding Sections 21.063 and 21.064 to read as follows:
1414 Sec. 21.063. TEACHER DESIGNATIONS ON CERTIFICATE. (a) The
1515 board shall place the appropriate designation issued to a teacher
1616 under Subchapter P on the teacher's certificate as soon as
1717 practicable after being notified by the agency of the issuance of
1818 the designation.
1919 (b) The board shall remove a designation under Subchapter P
2020 from a teacher's certificate on:
2121 (1) expiration of the designation, unless the agency
2222 notifies the board that the designation has been renewed; or
2323 (2) revocation of the designation under Section
2424 21.755(d).
2525 Sec. 21.064. LEGACY MASTER TEACHER CERTIFICATIONS. (a)
2626 The board shall recognize a master teacher certificate issued under
2727 former Section 21.0481, 21.0482, 21.0483, or 21.0484 until the
2828 certificate expires. The board shall note a designation of
2929 "legacy" on the certificate.
3030 (b) A master teacher certificate described by Subsection
3131 (a) is not eligible for funding under the educator effectiveness
3232 allotment under Section 42.170.
3333 SECTION 2. Section 21.355(d), Education Code, is amended to
3434 read as follows:
3535 (d) A school district or open-enrollment charter school
3636 shall [may] give the agency information regarding the performance
3737 of a teacher or administrator, including a document evaluating the
3838 performance of a teacher or administrator currently or previously
3939 employed by the district or school for purposes of an investigation
4040 conducted by the agency.
4141 SECTION 3. Section 21.402, Education Code, is amended by
4242 amending Subsections (a) and (c-1) and adding Subsections (c-2),
4343 (c-3), and (c-4) to read as follows:
4444 (a) Except as provided by Subsection (e-1) [or (f)], a
4545 school district must pay each [classroom teacher,] full-time
4646 librarian, full-time school counselor certified under Subchapter
4747 B, or full-time school nurse not less than the minimum monthly
4848 salary, based on the employee's level of experience in addition to
4949 other factors, as determined by commissioner rule, determined by
5050 the following formula:
5151 MS = SF x FS
5252 where:
5353 "MS" is the minimum monthly salary;
5454 "SF" is the applicable salary factor specified by Subsection
5555 (c); and
5656 "FS" is the amount, as determined by the commissioner under
5757 Subsection (b), of the basic allotment as provided by Section
5858 42.101(a) or (b) for a school district with a maintenance and
5959 operations tax rate at least equal to the state maximum compressed
6060 tax rate, as defined by Section 42.101(a).
6161 (c-1) Notwithstanding Subsections (a) and (b), each school
6262 district shall pay a monthly salary to each [classroom teacher,
6363 full-time speech pathologist,] full-time librarian, full-time
6464 school counselor certified under Subchapter B, and full-time school
6565 nurse that is at least equal to the following monthly salary or the
6666 monthly salary determined by the commissioner under Subsections (a)
6767 and (b), whichever is greater:

114114 (c-2) Except as provided by Subsection (c-4), a school
115115 district must pay each fully certified classroom teacher not less
116116 than the following monthly salary, based on the teacher's level of
117117 experience in addition to other factors, as determined by

165165 (c-3) For purposes of Subsection (c-2), a "fully certified
166166 classroom teacher" means a classroom teacher who holds a
167167 certificate issued under Subchapter B but does not include:
168168 (1) a person who holds an emergency certificate issued
169169 under Section 21.041(b)(2);
170170 (2) a person who holds a certificate issued pursuant
171171 to enrollment in an approved alternative certification program
172172 under Section 21.049 but who has not completed all program and other
173173 certification requirements;
174174 (3) a person who holds a school district teaching
175175 permit issued under Section 21.055; or
176176 (4) a person employed under a waiver granted by the
177177 commissioner under Section 7.056.
178178 (c-4) The board of trustees of a school district may adopt a
179179 minimum salary schedule based on performance tiers, as determined
180180 by teacher appraisal and performance criteria under Sections 21.351
181181 and 21.352, instead of years of experience. A minimum salary
182182 schedule adopted under this subsection:
183183 (1) is not required to have a salary factor based on
184184 minimum years of experience for a performance tier;
185185 (2) must include:
186186 (A) a minimum salary for each performance tier;
187187 and
188188 (B) at least one performance tier with a minimum
189189 salary of not less than the minimum salary under the salary schedule
190190 specified by Subsection (c-2) for a classroom teacher with 20 or
191191 more years of experience; and
192192 (3) may not set a minimum salary at an amount that is
193193 less than the minimum salary under the salary schedule specified by
194194 Subsection (c-2) for a classroom teacher with zero years of
195195 experience.
196196 SECTION 4. Chapter 21, Education Code, is amended by adding
197197 Subchapter P to read as follows:
198198 SUBCHAPTER P. RECOGNIZED, EXEMPLARY, AND MASTER TEACHER
199199 DESIGNATIONS
200200 Sec. 21.751. DEFINITION. In this subchapter, "classroom
201201 teacher" includes an individual who:
202202 (1) is a teacher of record who teaches at least half
203203 the average number of students for a teaching assignment at the
204204 school campus at which the teacher is employed; and
205205 (2) satisfies the amount of teaching time requirement
206206 in the definition of a classroom teacher under Section 5.001 by
207207 providing educator leadership, including collaborating with,
208208 mentoring, or supporting other teachers.
209209 Sec. 21.752. RECOGNIZED, EXEMPLARY, AND MASTER TEACHER
210210 DESIGNATIONS. (a) To recognize the performance of teachers in this
211211 state, the commissioner shall:
212212 (1) establish an approval process for school districts
213213 and open-enrollment charter schools to designate a teacher as a
214214 recognized, exemplary, or master teacher and include the
215215 designation on the teacher's teaching certificate;
216216 (2) develop and provide technical assistance for
217217 school districts and open-enrollment charter schools in making
218218 teacher designations, including:
219219 (A) methods to involve staff in locally
220220 developing the process for designating teachers under this
221221 subchapter; and
222222 (B) assistance focusing on problems faced by
223223 rural school districts; and
224224 (3) subject to Subsection (b), authorize school
225225 districts and open-enrollment charter schools to make teacher
226226 designations for a five-year period, provided that the district's
227227 teacher designation system meets the requirements under Section
228228 21.754.
229229 (b) The commissioner shall use an institution of higher
230230 education to verify that the appraisals of a representative sample
231231 of classroom teachers meet the requirements for teacher
232232 designations under this subchapter. Verification may include
233233 on-site classroom observations or observations by video or audio
234234 recording of classroom sessions.
235235 Sec. 21.753. ELIGIBILITY CRITERIA FOR TEACHER DESIGNATION.
236236 (a) To be eligible for a teacher designation under this subchapter,
237237 a classroom teacher must:
238238 (1) hold an eligible teaching certificate issued under
239239 Subchapter B; and
240240 (2) satisfy any additional requirements adopted by the
241241 school district or open-enrollment charter school at which the
242242 teacher is employed.
243243 (b) A school district or open-enrollment charter school may
244244 designate a classroom teacher as recognized if the classroom
245245 teacher:
246246 (1) holds a National Board Certification issued by the
247247 National Board for Professional Teaching Standards; and
248248 (2) meets the other requirements of this section.
249249 (c) Except as provided by Subsection (d), the commissioner
250250 may approve a school district or open-enrollment charter school to
251251 designate a teacher under this subchapter if the district's or
252252 school's designation system under Section 21.754 determines that
253253 among teachers in the state in similar teaching assignments, the
254254 teacher is:
255255 (1) for a recognized teacher, in the top 33 percent in
256256 teaching performance;
257257 (2) for an exemplary teacher, in the top 20 percent in
258258 teaching performance; or
259259 (3) for a master teacher, in the top 5 percent of
260260 teaching performance.
261261 (d) The commissioner may raise the percentages required
262262 under Subsection (c) to ensure consistency of teacher performance
263263 standards over multiple school years as statewide performance
264264 improves, including for the purpose of teacher designation
265265 renewals.
266266 Sec. 21.754. DISTRICT TEACHER DESIGNATION SYSTEMS. (a) A
267267 district's teacher designation system must incorporate:
268268 (1) an educator appraisal system that complies with
269269 Section 21.351 or 21.352, including incorporating student
270270 performance, which may be measured by student performance over
271271 multiple school years;
272272 (2) student perception surveys for the third grade
273273 level and higher;
274274 (3) educator leadership, including collaborating
275275 with, mentoring, or supporting other teachers;
276276 (4) reliable observation-based appraisal components,
277277 including the use of independent observers and processes to ensure
278278 inter-rater reliability of observers; and
279279 (5) reliable underlying student assessments used to
280280 evaluate student performance, including test security protocols
281281 and defined testing windows.
282282 (a-1) A school district's or open-enrollment charter
283283 school's teacher designation system is not required to incorporate
284284 the surveys required under Subsection (a)(2) until the 2022-2023
285285 school year. This subsection expires September 1, 2023.
286286 (b) The commissioner may not authorize a school district or
287287 open-enrollment charter school to make teacher designations under
288288 this subchapter until the district's teacher designation system has
289289 evaluated classroom teachers in compliance with Subsection (a)(4).
290290 (c) The commissioner may develop an auditing process for
291291 district teacher designation systems to maintain quality and ensure
292292 compliance. The commissioner may, as necessary:
293293 (1) revoke the commissioner's approval of a district's
294294 designation system;
295295 (2) require modifications to a district's designation
296296 system to retain the commissioner's approval;
297297 (3) suspend eligibility for funding for a district's
298298 noncompliance with an audit; or
299299 (4) recover funds under Section 42.258 from a district
300300 that has a designation system that is out of compliance or for which
301301 the commissioner's approval has been revoked.
302302 (d) The commissioner may adopt necessary reporting
303303 processes and timelines for the auditing process under Subsection
304304 (c).
305305 Sec. 21.755. VALIDITY AND EXPIRATION OF TEACHER
306306 DESIGNATION. (a) A teacher designation under this subchapter:
307307 (1) is valid until the teacher designation expires
308308 regardless of whether the teacher:
309309 (A) changes teaching assignment;
310310 (B) transfers school campuses; or
311311 (C) is employed by another school district or
312312 open-enrollment charter school; and
313313 (2) expires at the end of the school year during which
314314 the fifth anniversary of the date on which the teacher receives the
315315 designation occurs.
316316 (b) A teacher has no vested property right in a teacher
317317 designation assigned to the teacher under this subchapter.
318318 (c) A teacher designation issued under this subchapter is
319319 void on the determination that the designation was issued
320320 improperly. Subchapters C through H, Chapter 2001, Government
321321 Code, do not apply to the voiding of a teacher designation under
322322 this subsection.
323323 (d) The State Board for Educator Certification may revoke or
324324 suspend a certificate holder's teacher designation issued under
325325 this subchapter.
326326 Sec. 21.756. MULTIPLE DESIGNATIONS PROHIBITED. A teacher
327327 may receive only one teacher designation under this subchapter at
328328 any time. If a teacher qualifies for:
329329 (1) both a recognized and exemplary teacher
330330 designation, the teacher receives the exemplary designation; and
331331 (2) either a recognized or exemplary designation and a
332332 master designation, the teacher receives a master designation.
333333 Sec. 21.757. INFORMATION RELATING TO TEACHER AND STUDENT
334334 PERFORMANCE. (a) The agency, or an entity the agency contracts
335335 with to implement this subchapter, may access information required
336336 to verify an eligibility determination under this subchapter,
337337 including information from the school district or open-enrollment
338338 charter school at which the teacher is or was employed relating to
339339 the performance of the teacher's current or previous students.
340340 (b) The agency shall collect information necessary to
341341 implement this subchapter, which may include student performance
342342 information for a sample of students across the state and
343343 information regarding educator appraisals.
344344 (c) A school district or open-enrollment charter school
345345 shall provide any information required under this subchapter.
346346 (d) Information otherwise confidential remains
347347 confidential and is not subject to Chapter 552, Government Code.
348348 Sec. 21.758. FEES. (a) The commissioner may adopt fees for
349349 the authorization of school districts and open-enrollment charter
350350 schools to make teacher designations under this subchapter.
351351 (b) A fee adopted by the agency under this subchapter is not
352352 subject to Sections 2001.0045 and 2001.0221, Government Code.
353353 Sec. 21.759. STUDENT PERFORMANCE STUDY. (a) The
354354 commissioner shall periodically conduct a study using an external
355355 organization to determine the impact of the teacher designations
356356 issued under this subchapter on student performance.
357357 (b) The commissioner shall make recommendations as
358358 necessary to the governor and the legislature to improve the
359359 quality of and impact on student performance of teacher
360360 designations issued under this subchapter.
361361 Sec. 21.760. ADVISORY COMMITTEE OR PANEL. (a) The
362362 commissioner may appoint a committee or panel to advise, make
363363 recommendations, or make determinations relating to any duties
364364 assigned to the commissioner under this subchapter.
365365 (b) A committee or panel appointed under this section is not
366366 subject to Chapter 2110, Government Code.
367367 Sec. 21.761. RULES; FINALITY OF DECISIONS. (a) The
368368 commissioner may adopt rules to implement this subchapter.
369369 (b) A decision made by the commissioner under this
370370 subchapter is final and may not be appealed.
371371 SECTION 5. Section 25.112, Education Code, is amended by
372372 adding Subsection (g) to read as follows:
373373 (g) The limit in Subsection (a) does not apply to a class
374374 taught by a teacher who has been issued a recognized, exemplary, or
375375 master teacher designation under Subchapter P, Chapter 21.
376376 SECTION 6. Subchapter C, Chapter 42, Education Code, is
377377 amended by adding Sections 42.169, 42.170, and 42.171 to read as
378378 follows:
379379 Sec. 42.169. EDUCATOR SALARY TRANSITION ALLOTMENT FOR
380380 MINIMUM SALARY INCREASE. (a) A school district to which Section
381381 21.402 applies for the 2019-2020 school year is entitled to receive
382382 an annual allotment as determined by the following formula:
383383 A = 1.5 X S - ((CYM&O - BYM&O) X ADA)
384384 where:
385385 "A" is the allotment a district receives for purposes of
386386 paying the increased costs associated with the minimum salary
387387 schedule under Section 21.402 beginning with the 2019-2020 school
388388 year;
389389 "S" is the total amount of additional costs a district would
390390 be required to pay for salary and benefits for employees subject to
391391 the minimum salary schedule in the 2017-2018 school year if the
392392 minimum salary schedule for the 2019-2020 school year applied to
393393 those employees;
394394 "CYM&O" is the amount of a district's maintenance and
395395 operations entitlement under this chapter per student in average
396396 daily attendance for the current school year;
397397 "BYM&O" is the amount of a district's maintenance and
398398 operations entitlement under this chapter per student in average
399399 daily attendance for the 2018-2019 school year; and
400400 "ADA" is the average daily attendance for a district for the
401401 current school year.
402402 (b) For purposes of calculating the formula in Subsection
403403 (a), the commissioner shall:
404404 (1) if the value of "A" results in a negative number,
405405 use zero for the value of "A";
406406 (2) include in the calculation of an employee's salary
407407 and benefits an additional 4.2 percent of the amount that the
408408 employee is entitled to receive under the minimum salary schedule
409409 in effect for the 2019-2020 school year for the increased costs of
410410 Medicare and other payroll benefits;
411411 (3) exclude 50 percent of the following amounts to
412412 which a district is entitled in the calculation of a district's
413413 maintenance and operations entitlement:
414414 (A) the educator effectiveness allotment under
415415 Section 42.170; and
416416 (B) amounts received as educator effectiveness
417417 fee reimbursement under Section 42.171;
418418 (4) adjust the calculation under Subsection (a) to
419419 reflect:
420420 (A) a reduction in tax effort by a district;
421421 (B) property value adjustments due to a disaster;
422422 (C) any additional state aid due to disaster
423423 remediation; and
424424 (D) the sparsity adjustment under Section
425425 42.105;
426426 (5) exclude funding provided to a district for the
427427 2018-2019 school year under Sections 41.002(e)-(g) and former
428428 Subchapter H, Chapter 42;
429429 (6) if a school district receives a waiver relating to
430430 eligibility requirements for the national free or reduced-price
431431 lunch program under 42 U.S.C. Section 1751 et seq., use the number
432432 of educationally disadvantaged students on which the district's
433433 entitlement to compensatory education funds was based for the
434434 school year before the school year in which the district received
435435 the waiver, adjusted for estimated enrollment growth; and
436436 (7) include increased state contributions made under
437437 Section 825.405, Government Code, for the current school year as
438438 compared to the 2018-2019 school year.
439439 (c) A decision by the commissioner under this section is
440440 final and may not be appealed.
441441 Sec. 42.170. EDUCATOR EFFECTIVENESS ALLOTMENT. (a) In this
442442 section, "classroom teacher" has the meaning assigned by Section
443443 21.751.
444444 (b) For each classroom teacher with a teacher designation
445445 under Subchapter P, Chapter 21, employed by a school district, the
446446 school district is entitled to an allotment equal to:
447447 A = B + (SCE X DM)
448448 where:
449449 "A" is the allotment provided to a school district per
450450 classroom teacher who holds a teacher designation;
451451 "B" is the applicable base amount for a classroom teacher
452452 provided under Subsection (c);
453453 "SCE" is the state compensatory education factor determined
454454 under Subsection (d); and
455455 "DM" is the applicable designation multiplier for a classroom
456456 teacher under Subsection (e).
457457 (c) The base amount for each classroom teacher with a
458458 teacher designation is as follows:
459459 (1) $3,000 for each recognized teacher;
460460 (2) $6,000 for each exemplary teacher; and
461461 (3) $12,000 for each master teacher.
462462 (d) The state compensatory education factor is the amount
463463 equal to:
464464 (1) the sum of the individual student disadvantage
465465 index tier values divided by the total student population of the
466466 campus at which the teacher for which the allotment is being
467467 calculated is employed, where the individual student disadvantage
468468 index tier values are given a value of zero to four as determined by
469469 the commissioner based on the severity of a student's disadvantage;
470470 or
471471 (2) if the school district qualifies as a rural school
472472 district based on criteria adopted by the commissioner, the value
473473 that is the lesser of:
474474 (A) 4.0; or
475475 (B) the value that results from Subdivision (1)
476476 plus 2.0.
477477 (e) The designation multiplier is as follows for the
478478 applicable teacher designation:
479479 (1) $1,500 for recognized;
480480 (2) $3,000 for exemplary; and
481481 (3) $5,000 for master.
482482 (f) A district's allotment under Subsection (b) for a
483483 classroom teacher may not be greater than $32,000.
484484 (g) A school district is not eligible for an allotment under
485485 Subsection (b) for a classroom teacher whose designation has
486486 expired or been revoked.
487487 (h) The commissioner shall provide in an easily readable
488488 format a list of campuses with the potential allotment amounts that
489489 would be available for teachers with designations employed at the
490490 campus.
491491 (i) A district shall annually certify that all funds
492492 received under this section were used for:
493493 (1) educator compensation;
494494 (2) costs associated with implementing Subchapter P,
495495 Chapter 21; or
496496 (3) professional development for educators.
497497 (j) The commissioner shall provide funding under this
498498 section for teacher designations made on the basis of a classroom
499499 teacher's performance during the 2018-2019 school year if the
500500 district:
501501 (1) receives approval from the commissioner during the
502502 2019-2020 school year for the district's local teacher designation
503503 system; and
504504 (2) provides compensation to a classroom teacher for
505505 the 2019-2020 school year based on the teacher's qualifying
506506 performance for a designation.
507507 (j-1) Subsection (j) and this subsection expire September
508508 1, 2020.
509509 Sec. 42.171. EDUCATOR EFFECTIVENESS FEE REIMBURSEMENT. (a)
510510 A school district is entitled to reimbursement for any fee paid
511511 under Subchapter P, Chapter 21, or membership fees paid to the
512512 National Board for Professional Standards for the purpose of
513513 Section 21.753(b).
514514 (b) The commissioner shall provide reimbursement under this
515515 section for fees relating to teacher designations made on the basis
516516 of a classroom teacher's performance during the 2018-2019 school
517517 year if the district:
518518 (1) receives approval from the commissioner during the
519519 2019-2020 school year for the district's local teacher designation
520520 system; and
521521 (2) provides compensation to a classroom teacher for
522522 the 2019-2020 school year based on the teacher's qualifying
523523 performance for a designation.
524524 (b-1) Subsection (b) and this subsection expire September
525525 1, 2020.
526526 SECTION 7. Section 42.302(a), Education Code, is amended to
527527 read as follows:
528528 (a) Each school district is guaranteed a specified amount
529529 per weighted student in state and local funds for each cent of tax
530530 effort over that required for the district's local fund assignment
531531 up to the maximum level specified in this subchapter. The amount of
532532 state support, subject only to the maximum amount under Section
533533 42.303, is determined by the formula:
534534 GYA = (GL X WADA X DTR X 100) - LR
535535 where:
536536 "GYA" is the guaranteed yield amount of state funds to be
537537 allocated to the district;
538538 "GL" is the dollar amount guaranteed level of state and local
539539 funds per weighted student per cent of tax effort, which is an
540540 amount described by Subsection (a-1) or a greater amount for any
541541 year provided by appropriation;
542542 "WADA" is the number of students in weighted average daily
543543 attendance, which is calculated by dividing the sum of the school
544544 district's allotments under Subchapters B and C, less any allotment
545545 to the district for transportation, any additional funding
546546 [allotment] under Section 42.158, [or] 42.160, 42.169, 42.170, or
547547 42.171 and 50 percent of the adjustment under Section 42.102, by
548548 the basic allotment for the applicable year;
549549 "DTR" is the district enrichment tax rate of the school
550550 district, which is determined by subtracting the amounts specified
551551 by Subsection (b) from the total amount of maintenance and
552552 operations taxes collected by the school district for the
553553 applicable school year and dividing the difference by the quotient
554554 of the district's taxable value of property as determined under
555555 Subchapter M, Chapter 403, Government Code, or, if applicable,
556556 under Section 42.2521, divided by 100; and
557557 "LR" is the local revenue, which is determined by multiplying
558558 "DTR" by the quotient of the district's taxable value of property as
559559 determined under Subchapter M, Chapter 403, Government Code, or, if
560560 applicable, under Section 42.2521, divided by 100.
561561 SECTION 8. Sections 825.405(a), (b), (e), and (f),
562562 Government Code, are amended to read as follows:
563563 (a) An employing school district or an open-enrollment
564564 charter school, as applicable, shall pay the state's contribution
565565 on the portion of a member's salary that exceeds the statutory
566566 minimum salary for [For] members:
567567 (1) entitled to the minimum salary for certain school
568568 personnel under Section 21.402, Education Code;
569569 (2) [, and for members] who would have been entitled to
570570 the minimum salary for certain school personnel under former
571571 Section 16.056, Education Code, as that section existed on January
572572 1, 1995; and
573573 (3) who would be entitled to the minimum salary for
574574 certain school personnel under Section 21.402, Education Code, if
575575 the member was employed by a school district subject to that section
576576 instead of being employed by:
577577 (A) an open-enrollment charter school; or
578578 (B) a school district that has adopted a local
579579 innovation plan under Chapter 12A, Education Code, that exempts the
580580 district's employees from the minimum salary schedule under that
581581 section[, the employing district shall pay the state's contribution
582582 on the portion of the member's salary that exceeds the statutory
583583 minimum salary].
584584 (b) For purposes of this section,[:
585585 [(1)] the statutory minimum salary for a member
586586 described by:
587587 (1) Subsection (a)(1) [certain school personnel under
588588 Section 21.402, Education Code,] is the salary provided by Section
589589 21.402, Education Code [that section multiplied by the cost of
590590 education adjustment applicable under Section 42.102, Education
591591 Code, to the district in which the member is employed]; [and]
592592 (2) Subsection (a)(2) [the statutory minimum salary
593593 for members who would have been entitled to the minimum salary for
594594 certain school personnel under former Section 16.056, Education
595595 Code, as that section existed on January 1, 1995,] is a minimum
596596 salary computed in the same manner as the minimum salary for certain
597597 school personnel under Section 21.402, Education Code; and
598598 (3) Subsection (a)(3) is the minimum salary the member
599599 would have been entitled to if the member was subject to Section
600600 21.402, Education Code[, multiplied by the cost of education
601601 adjustment applicable under Section 42.102, Education Code, to the
602602 district in which the member is employed].
603603 (e) After the end of each school year, the retirement system
604604 shall certify to the commissioner of education:
605605 (1) the names of any employers [employing districts]
606606 that have failed to remit, within the period required by Section
607607 825.408, all contributions required under this section for the
608608 school year; and
609609 (2) the amounts of the unpaid contributions.
610610 (f) If the commissioner of education receives a
611611 certification under Subsection (e), the commissioner shall direct
612612 the comptroller of public accounts to withhold the amount
613613 certified, plus interest computed at the rate and in the manner
614614 provided by Section 825.408, from the first state money payable to
615615 the employer [school district]. The amount withheld shall be
616616 deposited to the credit of the appropriate accounts of the
617617 retirement system.
618618 SECTION 9. The following provisions of the Education Code
619619 are repealed:
620620 (1) Section 21.0481;
621621 (2) Section 21.0482;
622622 (3) Section 21.0483;
623623 (4) Section 21.0484;
624624 (5) Section 21.357;
625625 (6) Sections 21.402(f) and (h);
626626 (7) Section 21.410;
627627 (8) Section 21.411;
628628 (9) Section 21.412; and
629629 (10) Section 21.413.
630630 SECTION 10. The State Board for Educator Certification may
631631 not issue a new or renew a master teacher certificate issued under
632632 Section 21.0481, 21.0482, 21.0483, or 21.0484, Education Code, on
633633 or after the effective date of this Act.
634634 SECTION 11. This Act takes effect September 1, 2019.
