6	6	AN ACT
7	7	relating to the location and operation of certain concrete crushing
8	8	facilities.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 382.065, Health and Safety Code, is
11	11	amended by amending Subsection (b) and adding Subsection (e) to
12	12	read as follows:
13	13	(b) Subsection (a) does not apply to a concrete crushing
14	14	facility:
15	15	(1) at a location for which commission authorization
16	16	for the operation of a concrete crushing facility was in effect on
17	17	September 1, 2001;
18	18	(2) at a location that satisfies the distance
19	19	requirements of Subsection (a) at the time the application for the
20	20	initial authorization for the operation of that facility at that
21	21	location is filed with the commission, provided that the
22	22	authorization is granted and maintained, regardless of whether a
23	23	single or multifamily residence, school, or place of worship is
24	24	subsequently built or put to use within 440 yards of the facility;
25	25	[or]
26	26	(3) that:
27	27	(A) uses a concrete crusher:
28	28	(i) in the manufacture of products that
29	29	contain recycled materials; and
30	30	(ii) that is located in an enclosed
31	31	building; and
32	32	(B) is located:
33	33	(i) within 25 miles of an international
34	34	border; and
35	35	(ii) in a municipality with a population of
36	36	not less than 6,100 but not more than 20,000; or
37	37	(4) that:
38	38	(A) is located in a county with a population of
39	39	less than 50,000; and
40	40	(B) operates at a location:
41	41	(i) for not more than 90 days; and
42	42	(ii) only between the hours of 8 a.m. and 6
43	43	p.m.
44	44	(e) The commission shall impose a condition for the
45	45	authorization for the operation of a concrete crushing facility to
46	46	which the exception provided by Subsection (b)(4) applies that the
47	47	owner or operator of the facility must remove the aggregate
48	48	produced by the facility from the location of the facility not later
49	49	than the 30th day after the date of the expiration of the
50	50	authorization.
51	51	SECTION 2. Section 382.065(b), Health and Safety Code, as
52	52	amended by this Act, and Section 382.065(e) of that code, as added
53	53	by this Act, apply only to a permit to operate a concrete crushing
54	54	facility the application for which is filed on or after the
55	55	effective date of this Act. A permit the application for which is
56	56	filed before the effective date of this Act is governed by the law
57	57	in effect on the date of filing, and that law is continued in effect
58	58	for that purpose.
59	59	SECTION 3. This Act takes effect September 1, 2019.
