79 relating to the creation of a wet debris work group.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Subchapter C, Chapter 418, Government Code, is
1012 amended by adding Section 418.054 to read as follows:
1113 Sec. 418.054. WET DEBRIS WORK GROUP. (a) In this section:
1214 (1) "Wet debris" means natural or man-made debris
1315 located in bodies of water, including lakes, rivers, streams, bays,
1416 wetlands, and tidal areas, that results from a disaster.
1517 (2) "Work group" means the wet debris work group
1618 established under this section.
1719 (b) The wet debris work group is established and consists of
1820 at least 13 but not more than 21 representatives of local, state,
1921 and federal governmental entities and private entities who are
2022 appointed by the governor from a list submitted by the lieutenant
2123 governor and speaker of the house of representatives. The governor
2224 shall, to the extent possible, appoint to the work group
2325 representatives of:
2426 (1) the division;
2527 (2) the Texas Commission on Environmental Quality;
2628 (3) the Texas Department of Transportation;
2729 (4) the General Land Office;
2830 (5) the Texas Historical Commission;
2931 (6) the Federal Emergency Management Agency;
3032 (7) the National Oceanic and Atmospheric
3133 Administration;
3234 (8) the United States Army Corps of Engineers;
3335 (9) the United States Fish and Wildlife Service; and
3436 (10) local governments.
3537 (c) A representative of the division appointed to the work
3638 group shall serve as presiding officer of the work group.
3739 (d) The work group shall conduct a study to:
3840 (1) identify:
3941 (A) wet debris removal categories for bodies of
4042 water in the state and the applicable laws for each category;
4143 (B) current jurisdictions of local, state,
4244 federal, and private entities responsible for wet debris removal,
4345 including any concurrent, joint, or overlapping roles and
4446 responsibilities of those entities;
4547 (C) funding sources applicable to each wet debris
4648 removal category; and
4749 (D) issues that impede wet debris removal; and
4850 (2) provide recommendations for:
4951 (A) minimizing impediments to wet debris
5052 removal;
5153 (B) clarifying local, state, federal, and
5254 private entities' roles and responsibilities for wet debris
5355 removal; and
5456 (C) educating interested persons on the results
5557 of the study described by this subsection.
5658 (e) Not later than November 1, 2020, the work group shall
5759 submit a report containing the results of the study described by
5860 Subsection (d) to each member of the legislature.
5961 (f) The work group is abolished and this section expires
6062 January 1, 2021.
6163 SECTION 2. Not later than November 1, 2019, the governor
6264 shall appoint members to the wet debris work group as required by
6365 Section 418.054, Government Code, as added by this Act.
6466 SECTION 3. This Act takes effect immediately if it receives
6567 a vote of two-thirds of all the members elected to each house, as
6668 provided by Section 39, Article III, Texas Constitution. If this
6769 Act does not receive the vote necessary for immediate effect, this
6870 Act takes effect September 1, 2019.
