6	8		AN ACT
7	9		relating to the creation of a wet debris work group.
8	10		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	11		SECTION 1. Subchapter C, Chapter 418, Government Code, is
10	12		amended by adding Section 418.054 to read as follows:
11	13		Sec. 418.054. WET DEBRIS WORK GROUP. (a) In this section:
12	14		(1) "Wet debris" means natural or man-made debris
13	15		located in bodies of water, including lakes, rivers, streams, bays,
14	16		wetlands, and tidal areas, that results from a disaster.
15	17		(2) "Work group" means the wet debris work group
16	18		established under this section.
17	19		(b) The wet debris work group is established and consists of
18	20		at least 13 but not more than 21 representatives of local, state,
19	21		and federal governmental entities and private entities who are
20	22		appointed by the governor from a list submitted by the lieutenant
21	23		governor and speaker of the house of representatives. The governor
22	24		shall, to the extent possible, appoint to the work group
23	25		representatives of:
24	26		(1) the division;
25	27		(2) the Texas Commission on Environmental Quality;
26	28		(3) the Texas Department of Transportation;
27	29		(4) the General Land Office;
28	30		(5) the Texas Historical Commission;
29	31		(6) the Federal Emergency Management Agency;
30	32		(7) the National Oceanic and Atmospheric
31	33		Administration;
32	34		(8) the United States Army Corps of Engineers;
33	35		(9) the United States Fish and Wildlife Service; and
34	36		(10) local governments.
35	37		(c) A representative of the division appointed to the work
36	38		group shall serve as presiding officer of the work group.
37	39		(d) The work group shall conduct a study to:
38	40		(1) identify:
39	41		(A) wet debris removal categories for bodies of
40	42		water in the state and the applicable laws for each category;
41	43		(B) current jurisdictions of local, state,
42	44		federal, and private entities responsible for wet debris removal,
43	45		including any concurrent, joint, or overlapping roles and
44	46		responsibilities of those entities;
45	47		(C) funding sources applicable to each wet debris
46	48		removal category; and
47	49		(D) issues that impede wet debris removal; and
48	50		(2) provide recommendations for:
49	51		(A) minimizing impediments to wet debris
50	52		removal;
51	53		(B) clarifying local, state, federal, and
52	54		private entities' roles and responsibilities for wet debris
53	55		removal; and
54	56		(C) educating interested persons on the results
55	57		of the study described by this subsection.
56	58		(e) Not later than November 1, 2020, the work group shall
57	59		submit a report containing the results of the study described by
58	60		Subsection (d) to each member of the legislature.
59	61		(f) The work group is abolished and this section expires
60	62		January 1, 2021.
61	63		SECTION 2. Not later than November 1, 2019, the governor
62	64		shall appoint members to the wet debris work group as required by
63	65		Section 418.054, Government Code, as added by this Act.
64	66		SECTION 3. This Act takes effect immediately if it receives
65	67		a vote of two-thirds of all the members elected to each house, as
66	68		provided by Section 39, Article III, Texas Constitution. If this
67	69		Act does not receive the vote necessary for immediate effect, this
68	70		Act takes effect September 1, 2019.
