96 AN ACT
107 relating to the vaccination against bacterial meningitis of public
118 school students.
129 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1310 SECTION 1. Section 38.001, Education Code, is amended by
1411 adding Subsection (a-1) to read as follows:
15- (a-1) Except as provided by Subsection (c), each student
16- shall be fully immunized against bacterial meningitis in accordance
17- with the most recent recommendations of the Advisory Committee on
18- Immunization Practices of the Centers for Disease Control and
19- Prevention. The executive commissioner of the Health and Human
20- Services Commission shall adopt rules for the implementation of
21- this subsection.
22- SECTION 2. Not later than June 1, 2020, the executive
12+ (a-1) Each student shall be fully immunized against
13+ bacterial meningitis, except as provided by Subsection (c). To
14+ satisfy the requirement of this subsection, a student must show
15+ proof of a quadrivalent meningococcal conjugate vaccine and a
16+ booster dose in accordance with the recommended immunization
17+ schedule adopted by the Department of State Health Services.
18+ SECTION 2. Not later than December 1, 2019, the executive
2319 commissioner of the Health and Human Services Commission shall
2420 adopt the rules necessary to implement Section 38.001(a-1),
2521 Education Code, as added by this Act.
2622 SECTION 3. Section 38.001(a-1), Education Code, as added by
2723 this Act, applies beginning with the 2020-2021 school year.
2824 SECTION 4. This Act takes effect September 1, 2019.
