8 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 10 | SECTION 1. Section 545.066, Transportation Code, is amended | |
10 | 11 | by amending Subsection (c) and adding Subsection (g) to read as | |
11 | 12 | follows: | |
12 | 13 | (c) An offense under this section is a misdemeanor | |
13 | 14 | punishable by a fine of not less than $500 or more than $1,250, | |
14 | 15 | except that the offense is: | |
15 | 16 | (1) a misdemeanor punishable by a fine of not less than | |
16 | 17 | $1,000 or more than $2,000 if the person is convicted of a second or | |
17 | 18 | subsequent offense under this section committed within five years | |
18 | 19 | of the date on which the most recent preceding offense was | |
19 | 20 | committed; or | |
20 | - | (2) a felony of the | |

30 | 31 | to an offense committed on or after the effective date of this Act. | |
31 | 32 | An offense committed before the effective date of this Act is | |
32 | 33 | governed by the law in effect on the date the offense was committed, | |
33 | 34 | and the former law is continued in effect for that purpose. For | |
34 | 35 | purposes of this section, an offense was committed before the | |
35 | 36 | effective date of this Act if any element of the offense occurred | |
36 | 37 | before that date. | |
37 | 38 | SECTION 3. This Act takes effect September 1, 2019. |
