45 A BILL TO BE ENTITLED
56 AN ACT
67 relating to the prosecution of the criminal offense of passing a
78 school bus; increasing a criminal penalty.
89 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
910 SECTION 1. Section 545.066, Transportation Code, is amended
1011 by amending Subsection (c) and adding Subsection (g) to read as
1112 follows:
1213 (c) An offense under this section is a misdemeanor
1314 punishable by a fine of not less than $500 or more than $1,250,
1415 except that the offense is:
1516 (1) a misdemeanor punishable by a fine of not less than
1617 $1,000 or more than $2,000 if the person is convicted of a second or
1718 subsequent offense under this section committed within five years
1819 of the date on which the most recent preceding offense was
1920 committed; or
20- (2) a felony of the
21- third degree [Class A misdemeanor]
22- if the person causes serious bodily injury to another[; or
21+ (2) a felony of the second degree [Class A
22+ misdemeanor] if the person causes serious bodily injury to
23+ another[; or
2324 [(3) a state jail felony if the person has been
2425 previously convicted under Subdivision (2)].
2526 (g) If conduct constituting an offense under this section
2627 also constitutes an offense under another provision of law, the
2728 person may be prosecuted under either this section or the other
2829 provision.
2930 SECTION 2. The change in law made by this Act applies only
3031 to an offense committed on or after the effective date of this Act.
3132 An offense committed before the effective date of this Act is
3233 governed by the law in effect on the date the offense was committed,
3334 and the former law is continued in effect for that purpose. For
3435 purposes of this section, an offense was committed before the
3536 effective date of this Act if any element of the offense occurred
3637 before that date.
3738 SECTION 3. This Act takes effect September 1, 2019.
