128 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
139 SECTION 1. Section 2157.068(j), Government Code, is amended
1410 to read as follows:
1511 (j) The following entities may purchase commodity items
1612 through the department, and be charged a reasonable administrative
1713 fee, as provided by this section:
1814 (1) the Electric Reliability Council of Texas;
1915 (2) the Lower Colorado River Authority;
2016 (3) a private school, as defined by Section 5.001,
2117 Education Code;
2218 (4) a private or independent institution of higher
2319 education, as defined by Section 61.003, Education Code; [or]
2420 (5) a volunteer fire department, as defined by Section
2521 152.001, Tax Code;
26- (6) a county hospital, public hospital, or hospital
27- district; or
22+ (6) a county, public hospital, or hospital district;
23+ or
2824 (7) a public safety entity, as defined by 47 U.S.C.
2925 Section 1401.
3026 SECTION 2. Section 2170.004, Government Code, is amended to
3127 read as follows:
32- Sec. 2170.004. CONTRACTS WITH ENTITIES OTHER THAN STATE
28+ Sec. 2170.004 CONTRACTS WITH ENTITIES OTHER THAN STATE
3329 AGENCIES. The department may contract for use of the consolidated
3430 telecommunications system with:
3531 (1) each house of the legislature;
3632 (2) a legislative agency;
3733 (3) an agency that is not a state agency as defined by
3834 Section 2151.002;
3935 (4) a political subdivision, including a county,
4036 municipality, or district;
4137 (5) a private institution of higher education
4238 accredited by a recognized accrediting agency, as defined by
4339 Section 61.003, Education Code[, that:
4440 (A) engages in distance learning, as defined by
4541 Section 57.021, Utilities Code; and
4642 (B) receives federal funds for distance learning
47- initiatives]; [and]
43+ initiatives]; and
4844 (6) an assistance organization, as defined by Section
4945 2175.001;
5046 (7) a governmental entity of another state; and
5147 (8) a public safety entity, as defined by 47 U.S.C.
5248 Section 1401.
5349 SECTION 3. This Act takes effect immediately if it receives
5450 a vote of two-thirds of all the members elected to each house, as
5551 provided by Section 39, Article III, Texas Constitution. If this
5652 Act does not receive the vote necessary for immediate effect, this
5753 Act takes effect September 1, 2019.
