| 13 | 9 | SECTION 1. Section 2157.068(j), Government Code, is amended | |
| 14 | 10 | to read as follows: | |
| 15 | 11 | (j) The following entities may purchase commodity items | |
| 16 | 12 | through the department, and be charged a reasonable administrative | |
| 17 | 13 | fee, as provided by this section: | |
| 18 | 14 | (1) the Electric Reliability Council of Texas; | |
| 19 | 15 | (2) the Lower Colorado River Authority; | |
| 20 | 16 | (3) a private school, as defined by Section 5.001, | |

| 30 | 26 | SECTION 2. Section 2170.004, Government Code, is amended to | |

| 53 | 49 | SECTION 3. This Act takes effect immediately if it receives | |
| 54 | 50 | a vote of two-thirds of all the members elected to each house, as | |
| 55 | 51 | provided by Section 39, Article III, Texas Constitution. If this | |
| 56 | 52 | Act does not receive the vote necessary for immediate effect, this | |
| 57 | 53 | Act takes effect September 1, 2019. |
