410 AN ACT
511 relating to the dissolution of fire control, prevention, and
612 emergency medical services districts.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 344.260(a), Local Government Code, is
915 amended to read as follows:
1016 (a) If less than a majority of the votes cast in a
1117 continuation referendum election are for the continuation of a
1218 district or if a majority of the votes cast in a dissolution
1319 referendum are for dissolution of the district:
1420 (1) the board shall certify that fact to the secretary
1521 of state not later than the 10th day after the date of the canvass of
1622 the returns; and
1723 (2) the district is dissolved and ceases to operate as
1824 provided by Section 344.301.
1925 SECTION 2. Section 344.301, Local Government Code, is
2026 amended to read as follows:
2127 Sec. 344.301. TIME FOR DISSOLUTION OF DISTRICT. (a) A
2228 district is dissolved on the first uniform election date that
2329 occurs after the fifth anniversary of [five years after] the date
2430 the municipality began to impose taxes for district purposes if the
2531 district has not held a continuation or dissolution referendum.
2632 (b) The district is dissolved on the first uniform election
2733 date that occurs after the fifth anniversary of the date of the most
2834 recent continuation or dissolution referendum.
2935 (c) Subsection (b) does not apply to a district that is
3036 continued under Section 344.251(g), and that district is dissolved
3137 on the first uniform election date that occurs after the end
3238 [expiration] of the period for which it was continued.
3339 SECTION 3. This Act takes effect September 1, 2019.
