| 5 | 11 | | relating to the dissolution of fire control, prevention, and |
|---|
| 6 | 12 | | emergency medical services districts. |
|---|
| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Section 344.260(a), Local Government Code, is |
|---|
| 9 | 15 | | amended to read as follows: |
|---|
| 10 | 16 | | (a) If less than a majority of the votes cast in a |
|---|
| 11 | 17 | | continuation referendum election are for the continuation of a |
|---|
| 12 | 18 | | district or if a majority of the votes cast in a dissolution |
|---|
| 13 | 19 | | referendum are for dissolution of the district: |
|---|
| 14 | 20 | | (1) the board shall certify that fact to the secretary |
|---|
| 15 | 21 | | of state not later than the 10th day after the date of the canvass of |
|---|
| 16 | 22 | | the returns; and |
|---|
| 17 | 23 | | (2) the district is dissolved and ceases to operate as |
|---|
| 18 | 24 | | provided by Section 344.301. |
|---|
| 19 | 25 | | SECTION 2. Section 344.301, Local Government Code, is |
|---|
| 20 | 26 | | amended to read as follows: |
|---|
| 21 | 27 | | Sec. 344.301. TIME FOR DISSOLUTION OF DISTRICT. (a) A |
|---|
| 22 | 28 | | district is dissolved on the first uniform election date that |
|---|
| 23 | 29 | | occurs after the fifth anniversary of [five years after] the date |
|---|
| 24 | 30 | | the municipality began to impose taxes for district purposes if the |
|---|
| 25 | 31 | | district has not held a continuation or dissolution referendum. |
|---|
| 26 | 32 | | (b) The district is dissolved on the first uniform election |
|---|
| 27 | 33 | | date that occurs after the fifth anniversary of the date of the most |
|---|
| 28 | 34 | | recent continuation or dissolution referendum. |
|---|
| 29 | 35 | | (c) Subsection (b) does not apply to a district that is |
|---|
| 30 | 36 | | continued under Section 344.251(g), and that district is dissolved |
|---|
| 31 | 37 | | on the first uniform election date that occurs after the end |
|---|
| 32 | 38 | | [expiration] of the period for which it was continued. |
|---|
| 33 | 39 | | SECTION 3. This Act takes effect September 1, 2019. |
