9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 163.003, Election Code, is amended to | |
11 | 11 | read as follows: | |
12 | 12 | Sec. 163.003. CONSISTENCY WITH STATE LAW. (a) The rules | |
13 | 13 | adopted by a political party must be consistent with state law, | |
14 | 14 | subject to Subsection (b). | |
15 | 15 | (b) A political party may by rule provide that a provision | |
16 | 16 | of this title governing the electoral affairs of the party does not | |
17 | 17 | apply to the extent that a party rule on electoral affairs is | |
18 | 18 | inconsistent with a provision of this title. | |
19 | 19 | SECTION 2. Section 163.007, Election Code, is amended to | |
20 | 20 | read as follows: | |
21 | 21 | Sec. 163.007. RULES ENFORCEABLE BY MANDAMUS. A rule on | |
22 | 22 | electoral affairs is enforceable by writ of mandamus in the same | |
23 | 23 | manner as if the rule were a statute, except as otherwise provided | |
24 | 24 | by party rule. | |
25 | 25 | SECTION 3. This Act takes effect immediately if it receives | |
26 | 26 | a vote of two-thirds of all the members elected to each house, as | |
27 | 27 | provided by Section 39, Article III, Texas Constitution. If this | |
28 | 28 | Act does not receive the vote necessary for immediate effect, this | |
29 | 29 | Act takes effect September 1, 2019. |
