66 AN ACT
77 relating to the applicability of certain state law to electoral
88 affairs governed by political party rules.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 163.003, Election Code, is amended to
1111 read as follows:
1212 Sec. 163.003. CONSISTENCY WITH STATE LAW. (a) The rules
1313 adopted by a political party must be consistent with state law,
1414 subject to Subsection (b).
1515 (b) A political party may by rule provide that a provision
1616 of this title governing the electoral affairs of the party does not
1717 apply to the extent that a party rule on electoral affairs is
1818 inconsistent with a provision of this title.
1919 SECTION 2. Section 163.007, Election Code, is amended to
2020 read as follows:
2121 Sec. 163.007. RULES ENFORCEABLE BY MANDAMUS. A rule on
2222 electoral affairs is enforceable by writ of mandamus in the same
2323 manner as if the rule were a statute, except as otherwise provided
2424 by party rule.
2525 SECTION 3. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2019.
