| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter D, Chapter 551, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 551.0727 to read as follows: |
|---|
| 12 | 12 | | Sec. 551.0727. HOSPITAL DISTRICT: DELIBERATION REGARDING |
|---|
| 13 | 13 | | CONTRACT BEING NEGOTIATED; CLOSED MEETING. (a) The governing board |
|---|
| 14 | 14 | | of a hospital district created under general or special law may |
|---|
| 15 | 15 | | conduct a closed meeting to deliberate business and financial |
|---|
| 16 | 16 | | issues relating to a contract being negotiated if, before |
|---|
| 17 | 17 | | conducting the closed meeting: |
|---|
| 18 | 18 | | (1) the governing board votes unanimously that |
|---|
| 19 | 19 | | deliberation in an open meeting would have a detrimental effect on |
|---|
| 20 | 20 | | the position of the governing board in negotiations with a third |
|---|
| 21 | 21 | | person; and |
|---|
| 22 | 22 | | (2) the attorney advising the governing board issues a |
|---|
| 23 | 23 | | written determination that deliberation in an open meeting would |
|---|
| 24 | 24 | | have a detrimental effect on the position of the governing board in |
|---|
| 25 | 25 | | negotiations with a third person. |
|---|
| 26 | 26 | | (b) Notwithstanding Section 551.103(a), the governing board |
|---|
| 27 | 27 | | of a hospital district must make a recording of the proceedings of a |
|---|
| 28 | 28 | | closed meeting to deliberate the information. |
|---|
| 29 | 29 | | SECTION 2. Section 551.085, Government Code, is amended by |
|---|
| 30 | 30 | | adding Subsection (c) to read as follows: |
|---|
| 31 | 31 | | (c) This chapter does not require the governing board of a |
|---|
| 32 | 32 | | hospital district created under general or special law to conduct |
|---|
| 33 | 33 | | an open meeting to deliberate information relating to a proposed |
|---|
| 34 | 34 | | expansion of an existing service or product line of the hospital |
|---|
| 35 | 35 | | district before publicly announcing the expansion. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect September 1, 2019. |
