66 AN ACT
77 relating to the authority of a hospital district governing board to
88 conduct a closed meeting to deliberate certain issues.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 551, Government Code, is
1111 amended by adding Section 551.0727 to read as follows:
1212 Sec. 551.0727. HOSPITAL DISTRICT: DELIBERATION REGARDING
1313 CONTRACT BEING NEGOTIATED; CLOSED MEETING. (a) The governing board
1414 of a hospital district created under general or special law may
1515 conduct a closed meeting to deliberate business and financial
1616 issues relating to a contract being negotiated if, before
1717 conducting the closed meeting:
1818 (1) the governing board votes unanimously that
1919 deliberation in an open meeting would have a detrimental effect on
2020 the position of the governing board in negotiations with a third
2121 person; and
2222 (2) the attorney advising the governing board issues a
2323 written determination that deliberation in an open meeting would
2424 have a detrimental effect on the position of the governing board in
2525 negotiations with a third person.
2626 (b) Notwithstanding Section 551.103(a), the governing board
2727 of a hospital district must make a recording of the proceedings of a
2828 closed meeting to deliberate the information.
2929 SECTION 2. Section 551.085, Government Code, is amended by
3030 adding Subsection (c) to read as follows:
3131 (c) This chapter does not require the governing board of a
3232 hospital district created under general or special law to conduct
3333 an open meeting to deliberate information relating to a proposed
3434 expansion of an existing service or product line of the hospital
3535 district before publicly announcing the expansion.
3636 SECTION 3. This Act takes effect September 1, 2019.
