55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to information and contraceptives provided to a sexual
88 assault survivor.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 323.004, Health and Safety Code, is
1111 amended by amending Subsection (b) and adding Subsection (e) to
1212 read as follows:
1313 (b) A health care facility providing care to a sexual
1414 assault survivor shall provide the survivor with:
1515 (1) subject to Subsection (b-1), a forensic medical
1616 examination in accordance with Subchapter B, Chapter 420,
1717 Government Code, if the examination has been requested by a law
1818 enforcement agency under Article 56.06, Code of Criminal Procedure,
1919 or is conducted under Article 56.065, Code of Criminal Procedure;
2020 (2) a private area, if available, to wait or speak with
2121 the appropriate medical, legal, or sexual assault crisis center
2222 staff or volunteer until a physician, nurse, or physician assistant
2323 is able to treat the survivor;
2424 (3) access to a sexual assault program advocate, if
2525 available, as provided by Article 56.045, Code of Criminal
2626 Procedure;
2727 (4) the information form required by Section 323.005;
2828 (5) a private treatment room, if available;
2929 (6) if indicated by the history of contact, access to
3030 appropriate prophylaxis for exposure to sexually transmitted
3131 infections; [and]
3232 (7) the name and telephone number of the nearest
3333 sexual assault crisis center;
3434 (8) medically accurate information about the services
3535 this state provides to sexual assault survivors, including
3636 information necessary for the survivor to make an informed decision
3737 on emergency and nonemergency contraceptives;
3838 (9) emergency contraceptives provided at no cost to
3939 the survivor;
4040 (10) a nonemergency contraceptive of the survivor's
4141 choice provided at no cost to the survivor; and
4242 (11) if necessary, a list of clinics in the survivor's
4343 geographic area that provide follow-up services related to the
4444 contraceptive provided to the survivor under Subdivision (10).
4545 (e) A health care facility providing a contraceptive to a
4646 sexual assault survivor under Subsection (b)(9) or (10) may apply
4747 to the Health and Human Services Commission in the form and manner
4848 provided by commission rule for reimbursement of the cost of the
4949 contraceptive and any related medical expenses incurred by the
5050 facility related to providing the contraceptive. The commission
5151 shall reimburse a facility if the facility timely provides a
5252 complete application to the commission.
5353 SECTION 2. As soon as practicable after the effective date
5454 of this Act, the executive commissioner of the Health and Human
5555 Services Commission shall adopt rules necessary to implement
5656 Section 323.004, Health and Safety Code, as amended by this Act.
5757 SECTION 3. This Act takes effect September 1, 2019.
