5 | 11 | | relating to paid leave for a state employee who is a search and |
---|
6 | 12 | | rescue volunteer. |

7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 14 | | SECTION 1. Section 661.905, Government Code, is amended to |
---|
9 | 15 | | read as follows: |
---|
10 | 16 | | Sec. 661.905. VOLUNTEER FIREFIGHTERS, [AND] EMERGENCY |
---|
11 | 17 | | MEDICAL SERVICES VOLUNTEERS, AND SEARCH AND RESCUE VOLUNTEERS. (a) |
---|
12 | 18 | | In this section: |
---|
13 | 19 | | (1) "Emergency[, "emergency] medical services |
---|
14 | 20 | | volunteer" has the meaning assigned by Section 773.003, Health and |
---|
15 | 21 | | Safety Code. |
---|
16 | 22 | | (2) "Search and rescue volunteer" means an individual |
---|
17 | 23 | | who without remuneration, except reimbursement for expenses, |
---|
18 | 24 | | provides services for or on behalf of an organization that conducts |
---|
19 | 25 | | search and rescue activities. |
---|
20 | 26 | | (b) A state employee who is a volunteer firefighter, [or] an |
---|
21 | 27 | | emergency medical services volunteer, or a search and rescue |
---|
22 | 28 | | volunteer is entitled to a leave of absence without a deduction in |
---|
23 | 29 | | salary to attend fire service, [or] emergency medical services, or |
---|
24 | 30 | | search and rescue training conducted by a state agency or |
---|
25 | 31 | | institution of higher education. Leave without a deduction in |
---|
26 | 32 | | salary under this subsection may not exceed five working days in a |
---|
27 | 33 | | fiscal year. |
---|
28 | 34 | | (c) A state agency or institution of higher education may |
---|
29 | 35 | | grant leave without a deduction in salary to a volunteer |
---|
30 | 36 | | firefighter, [or] an emergency medical services volunteer, or a |
---|
31 | 37 | | search and rescue volunteer for the purpose of allowing the |
---|
32 | 38 | | firefighter, [or] emergency medical services volunteer, or search |
---|
33 | 39 | | and rescue volunteer to respond to emergency fire, [or] medical, or |
---|
34 | 40 | | search and rescue situations if the agency or institution has an |
---|
35 | 41 | | established policy for granting that leave. |
---|
36 | 42 | | SECTION 2. This Act takes effect September 1, 2019. |
