410 AN ACT
511 relating to paid leave for a state employee who is a search and
612 rescue volunteer.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 661.905, Government Code, is amended to
915 read as follows:
1016 Sec. 661.905. VOLUNTEER FIREFIGHTERS, [AND] EMERGENCY
1117 MEDICAL SERVICES VOLUNTEERS, AND SEARCH AND RESCUE VOLUNTEERS. (a)
1218 In this section:
1319 (1) "Emergency[, "emergency] medical services
1420 volunteer" has the meaning assigned by Section 773.003, Health and
1521 Safety Code.
1622 (2) "Search and rescue volunteer" means an individual
1723 who without remuneration, except reimbursement for expenses,
1824 provides services for or on behalf of an organization that conducts
1925 search and rescue activities.
2026 (b) A state employee who is a volunteer firefighter, [or] an
2127 emergency medical services volunteer, or a search and rescue
2228 volunteer is entitled to a leave of absence without a deduction in
2329 salary to attend fire service, [or] emergency medical services, or
2430 search and rescue training conducted by a state agency or
2531 institution of higher education. Leave without a deduction in
2632 salary under this subsection may not exceed five working days in a
2733 fiscal year.
2834 (c) A state agency or institution of higher education may
2935 grant leave without a deduction in salary to a volunteer
3036 firefighter, [or] an emergency medical services volunteer, or a
3137 search and rescue volunteer for the purpose of allowing the
3238 firefighter, [or] emergency medical services volunteer, or search
3339 and rescue volunteer to respond to emergency fire, [or] medical, or
3440 search and rescue situations if the agency or institution has an
3541 established policy for granting that leave.
3642 SECTION 2. This Act takes effect September 1, 2019.
