44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the use of tax revenue by certain municipalities for the
77 payment of certain hotel-related bonds or other obligations.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 351.102(e) and (g), Tax Code, are
1010 amended to read as follows:
1111 (e) In addition to the municipalities described by
1212 Subsection (b), that subsection also applies to:
1313 (1) a municipality with a population of at least
1414 110,000 but not more than 135,000 at least part of which is located
1515 in a county with a population of not more than 135,000;
1616 (2) a municipality with a population of at least 9,000
1717 but not more than 10,000 that is located in two counties, each of
1818 which has a population of at least 662,000 and a southern border
1919 with a county with a population of 2.3 million or more;
2020 (3) a municipality with a population of at least
2121 200,000 but not more than 300,000 that contains a component
2222 institution of the Texas Tech University System;
2323 (4) a municipality with a population of at least
2424 95,000 that borders Lake Lewisville;
2525 (5) a municipality that:
2626 (A) contains a portion of Cedar Hill State Park;
2727 (B) has a population of more than 45,000;
2828 (C) is located in two counties, one of which has a
2929 population of more than two million and one of which has a
3030 population of more than 149,000; and
3131 (D) has adopted a capital improvement plan for
3232 the construction or expansion of a convention center facility;
3333 (6) a municipality with a population of less than
3434 6,000 that:
3535 (A) is located in two counties each with a
3636 population of 600,000 or more that are both adjacent to a county
3737 with a population of two million or more;
3838 (B) has full-time police and fire departments;
3939 and
4040 (C) has adopted a capital improvement plan for
4141 the construction or expansion of a convention center facility;
4242 (7) a municipality with a population of at least
4343 56,000 that:
4444 (A) borders Lake Ray Hubbard; and
4545 (B) is located in two counties, one of which has a
4646 population of less than 80,000;
4747 (8) a municipality with a population of more than
4848 83,000, that borders Clear Lake, and that is primarily located in a
4949 county with a population of less than 300,000;
5050 (9) a municipality with a population of less than
5151 2,000 that:
5252 (A) is located adjacent to a bay connected to the
5353 Gulf of Mexico;
5454 (B) is located in a county with a population of
5555 290,000 or more that is adjacent to a county with a population of
5656 four million or more; and
5757 (C) has a boardwalk on the bay;
5858 (10) a municipality with a population of 75,000 or
5959 more that:
6060 (A) is located wholly in one county with a
6161 population of 575,000 or more that is adjacent to a county with a
6262 population of four million or more; and
6363 (B) has adopted a capital improvement plan for
6464 the construction or expansion of a convention center facility;
6565 (11) a municipality with a population of less than
6666 75,000 that is located in three counties, at least one of which has
6767 a population of at least four million; [and]
6868 (12) an eligible coastal municipality with a
6969 population of more than 3,000 but less than 5,000; and
7070 (13) a municipality with a population of 6,100 or less
7171 that:
7272 (A) is located in two counties one with a
7373 population of 788,400 or more and the other county with a population
7474 of 666,700 or more; and
7575 (B) contains a portion of state highway 289.
7676 (g) A municipality to which this section applies may not
7777 receive or pledge revenue or funds under Subsection (b) or (c) for a
7878 hotel project unless the municipality enters into an agreement with
7979 a person for the development of the hotel project before September
8080 1, 2019.
8181 SECTION 2. This Act takes effect immediately if it receives
8282 a vote of two-thirds of all the members elected to each house, as
8383 provided by Section 39, Article III, Texas Constitution. If this
8484 Act does not receive the vote necessary for immediate effect, this
8585 Act takes effect September 1, 2019.
