9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 101.106(e), Civil Practice and Remedies | |
11 | 11 | Code, is amended to read as follows: | |
12 | 12 | (e) If a suit is filed asserting a claim for which this | |
13 | 13 | chapter waives sovereign or governmental immunity [under this | |
14 | 14 | chapter] against both a governmental unit and any of its employees, | |
15 | 15 | the claim against the employee [employees] shall immediately be | |
16 | 16 | dismissed on the filing of a motion by the governmental unit. | |
17 | 17 | SECTION 2. Section 101.106(e), Civil Practice and Remedies | |
18 | 18 | Code, as amended by this Act, applies only to an action filed on or | |
19 | 19 | after the effective date of this Act. An action that is filed | |
20 | 20 | before the effective date of this Act is governed by the law | |
21 | 21 | applicable to the action immediately before the effective date of | |
22 | 22 | this Act, and that law is continued in effect for that purpose. | |
23 | 23 | SECTION 3. This Act takes effect September 1, 2019. |
