9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 32.024(l), Human Resources Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | (l) The executive commissioner shall set the income | |
13 | 13 | eligibility cap for medical assistance for: | |
14 | 14 | (1) pregnant women and infants up to age one at not | |
15 | 15 | less than 130 percent of the federal poverty guidelines; and | |
16 | 16 | (2) parents and eligible caretaker relatives at not | |
17 | 17 | less than 100 percent of the federal poverty guidelines. | |
18 | 18 | SECTION 2. If before implementing any provision of this Act | |
19 | 19 | a state agency determines that an additional waiver or additional | |
20 | 20 | authorization from a federal agency is necessary for implementation | |
21 | 21 | of that provision, the agency affected by the provision shall | |
22 | 22 | request the waiver or authorization and may delay implementing that | |
23 | 23 | provision until the waiver or authorization is granted. | |
24 | 24 | SECTION 3. This Act takes effect September 1, 2019. |
