55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the licensing of certain child-care facilities that
88 detain certain children.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 42, Human Resources Code,
1111 is amended by adding Section 42.0539 to read as follows:
1212 Sec. 42.0539. RESIDENTIAL DETENTION FACILITIES.
1313 Notwithstanding any other law, the commission shall:
1414 (1) license each child-care facility, that is operated
1515 by or under a contract with United States Immigration and Customs
1616 Enforcement or the United States Department of Health and Human
1717 Services to enforce federal immigration laws and that detains
1818 unaccompanied children, in the same manner as the commission
1919 licenses a residential child-care facility under this chapter; and
2020 (2) require the facility to comply with the same
2121 requirements, including minimum standards, applicable to a
2222 residential child-care facility.
2323 SECTION 2. A child-care facility subject to Section
2424 42.0539, Human Resources Code, as added by this Act, must obtain the
2525 required license not later than December 1, 2019.
2626 SECTION 3. This Act takes effect September 1, 2019.
