9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter C, Chapter 42, Human Resources Code, | |
11 | 11 | is amended by adding Section 42.0539 to read as follows: | |
12 | 12 | Sec. 42.0539. RESIDENTIAL DETENTION FACILITIES. | |
13 | 13 | Notwithstanding any other law, the commission shall: | |
14 | 14 | (1) license each child-care facility, that is operated | |
15 | 15 | by or under a contract with United States Immigration and Customs | |
16 | 16 | Enforcement or the United States Department of Health and Human | |
17 | 17 | Services to enforce federal immigration laws and that detains | |
18 | 18 | unaccompanied children, in the same manner as the commission | |
19 | 19 | licenses a residential child-care facility under this chapter; and | |
20 | 20 | (2) require the facility to comply with the same | |
21 | 21 | requirements, including minimum standards, applicable to a | |
22 | 22 | residential child-care facility. | |
23 | 23 | SECTION 2. A child-care facility subject to Section | |
24 | 24 | 42.0539, Human Resources Code, as added by this Act, must obtain the | |
25 | 25 | required license not later than December 1, 2019. | |
26 | 26 | SECTION 3. This Act takes effect September 1, 2019. |
