44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the designation of a constable or deputy constable as a
77 weight enforcement officer in certain counties.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 621.4015(a), Transportation Code, is
1010 amended to read as follows:
1111 Sec. 621.4015. DESIGNATION BY COMMISSIONERS COURT. (a) A
1212 county commissioners court may designate a constable or deputy
1313 constable of the county as a weight enforcement officer in a county:
1414 (1) that is a county with a population of 1.5 million
1515 or more and is within 200 miles of an international border; or
1616 (2) that is adjacent to a county with a population of
1717 3.3 million or more; [and]
1818 (3) in which a planned community is located that has
1919 20,000 or more acres of land, that was originally established under
2020 the Urban Growth and New Community Development Act of 1970 (42
2121 U.S.C. Section 4501 et seq.), and that is subject to restrictive
2222 covenants containing ad valorem or annual variable budget based
2323 assessments on real property; or
2424 (4) a county that:
2525 (A) has a population of 425,000 or more;
2626 (B) is adjacent to a county with a population of
2727 3.3 million or more; and
2828 (C) contains a portion of the San Jacinto River
2929 .
3030 SECTION 2. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2019.
