119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Subtitle B, Title 9, Health and Safety Code, is
1311 amended by adding Chapter 786 to read as follows:
1412 CHAPTER 786. MENTAL HEALTH AWARENESS TRAINING
1513 FOR FIRST RESPONDERS
1614 Sec. 786.0001. DEFINITIONS. In this chapter:
1715 (1) "First responder" has the meaning assigned by
1816 Section 421.095, Government Code.
1917 (2) "First responder training program" means a program
2018 that provides training required for certification or licensure as a
2119 first responder, including the training required under:
2220 (A) Chapter 773;
2321 (B) Chapter 419, Government Code; and
2422 (C) Chapter 1701, Occupations Code.
2523 Sec. 786.0002. MENTAL HEALTH AWARENESS TRAINING REQUIRED.
2624 (a) A person who provides to first responders and first responder
2725 trainees a first responder training program shall:
2826 (1) include as part of the program at least six hours
2927 of training on mental health awareness that covers:
3028 (A) basic mental health issues for first
3129 responders;
3230 (B) the impact of chronic trauma on a first
3331 responder's duties;
3432 (C) signs and symptoms of mental illness; and
3533 (D) strategies for first responders to attain
3634 wellness and resiliency; and
3735 (2) require first responders and first responder
3836 trainees to complete the training described by Subdivision (1) as
3937 part of the training program.
4038 (b) In providing the training described by Subsection (a), a
4139 person who provides a first responder training program must use a
4240 mental health awareness training curriculum developed or adopted
4341 under Section 786.0003.
4442 Sec. 786.0003. MENTAL HEALTH AWARENESS TRAINING
4543 CURRICULUM. (a) The Health and Human Services Commission shall
4644 develop or adopt a curriculum for the first responder mental health
4745 awareness training required by Section 786.0002. The commission
4846 shall collaborate with agencies that license or certify first
4947 responders in the development or adoption of the curriculum.
5048 (b) Each state agency that licenses or certifies first
5149 responders shall ensure that the applicable first responder
5250 training programs provided to first responders and first responder
5351 trainees use the mental health awareness training curriculum
5452 developed or adopted by the commission under this section.
55- SECTION 2. Section 1701.253, Occupations Code, is amended
56- by adding Subsection (p) to read as follows:
57- (p) As part of the minimum curriculum requirements, the
58- commission shall require an officer to complete the mental health
59- awareness training curriculum developed or adopted by the Health
60- and Human Services Commission under Section 786.0003, Health and
61- Safety Code.
62- SECTION 3. (a) As soon as practicable after the effective
63- date of this Act:

6455 (1) the Health and Human Services Commission shall
6556 develop or adopt the first responder mental health awareness
6657 training curriculum required by Section 786.0003, Health and Safety
6758 Code, as added by this Act; and
6859 (2) each state agency that licenses or certifies first
6960 responders subject to Chapter 786, Health and Safety Code, as added
7061 by this Act, shall ensure that:
7162 (A) each first responder training program
7263 subject to the chapter includes the mental health awareness
7364 training and curriculum required by that chapter; and
7465 (B) each first responder and first responder
7566 trainee subject to the chapter completes the required training.
76- (b) A peace officer or reserve law enforcement officer who
77- holds a license under Chapter 1701, Occupations Code, issued on or
78- before January 1, 2020, shall complete the mental health awareness
79- training curriculum required by Section 1701.253(p), Occupations
80- Code, as added by this Act, not later than January 1, 2022.
81- SECTION 4. This Act takes effect September 1, 2019.
