9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter H, Chapter 201, Transportation Code, | |
11 | 11 | is amended by adding Section 201.605 to read as follows: | |
12 | 12 | Sec. 201.605. ECONOMIC IMPACT REVIEW. (a) The commission | |
13 | 13 | by rule shall provide for the commission's review of the economic | |
14 | 14 | impact of the department's transportation projects on businesses | |
15 | 15 | located in the area of a project. The rules must provide for: | |
16 | 16 | (1) public comment on the commission's economic impact | |
17 | 17 | reviews, including the types of projects for which public hearings | |
18 | 18 | are required, and a procedure for requesting a public hearing on an | |
19 | 19 | economic impact review for which a public hearing is not required; | |
20 | 20 | (2) the commission's evaluation of direct and indirect | |
21 | 21 | effects of the department's projects; | |
22 | 22 | (3) analysis of project alternatives; and | |
23 | 23 | (4) a written report that briefly explains the | |
24 | 24 | commission's decision on a project and that specifies any | |
25 | 25 | mitigation measures on economic harm on which the project is | |
26 | 26 | conditioned. | |
27 | 27 | (b) An economic impact review of a project must be conducted | |
28 | 28 | in the time required for an environmental review of the project. | |
29 | 29 | (c) The commission shall consider the results of its reviews | |
30 | 30 | in executing its duties. | |
31 | 31 | SECTION 2. This Act takes effect September 1, 2019. |
