412 AN ACT
513 relating to an intercollegiate athletics fee at the University of
614 North Texas at Dallas.
715 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
816 SECTION 1. Subchapter E, Chapter 54, Education Code, is
917 amended by adding Section 54.5192 to read as follows:
1018 Sec. 54.5192. INTERCOLLEGIATE ATHLETICS FEE; UNIVERSITY OF
1119 NORTH TEXAS AT DALLAS. (a) The board of regents of the University
1220 of North Texas System may charge each student enrolled at the
1321 University of North Texas at Dallas an intercollegiate athletics
1422 fee in an initial amount not to exceed $10 per semester credit hour
1523 for each regular semester or summer session. The amount of the fee
1624 may be increased only as provided by Subsection (e).
1725 (b) A student enrolled in more than 12 semester credit hours
1826 shall pay the fee in an amount equal to the amount charged a student
1927 enrolled in 12 semester credit hours during the same semester or
2028 session.
2129 (c) Revenue from the fee charged under this section may be
2230 used only to develop and maintain an intercollegiate athletics
2331 program at the university.
2432 (d) The fee may not be charged unless approved by a majority
2533 vote of the students enrolled at the university who participate in a
2634 general student election held for that purpose.
2735 (e) The amount of the fee per semester credit hour may be
2836 increased from one academic year to the next only if approved by a
2937 majority vote of the students participating in a general student
3038 election held for that purpose or, if the amount of the increase
3139 does not exceed five percent, by a majority vote of the legislative
3240 body of the student government of the university.
3341 (f) The ballot proposition for an election to approve a
3442 proposed initial fee under Subsection (d) or a proposed fee
3543 increase under Subsection (e) must:
3644 (1) clearly state the amount of the proposed fee or fee
3745 increase, as applicable; and
3846 (2) describe the reason for the proposed fee or fee
3947 increase, as applicable.
4048 (g) A fee charged under this section is in addition to any
4149 other fee authorized by law and may not be considered in determining
4250 the maximum amount of student services fees that may be charged each
4351 student enrolled at the university under Section 54.503.
4452 SECTION 2. A fee may not be charged under Section 54.5192,
4553 Education Code, as added by this Act, before the 2019 fall semester.
4654 SECTION 3. This Act takes effect immediately if it receives
4755 a vote of two-thirds of all the members elected to each house, as
4856 provided by Section 39, Article III, Texas Constitution. If this
4957 Act does not receive the vote necessary for immediate effect, this
5058 Act takes effect September 1, 2019.
