4	12		AN ACT
5	13		relating to an intercollegiate athletics fee at the University of
6	14		North Texas at Dallas.
7	15		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	16		SECTION 1. Subchapter E, Chapter 54, Education Code, is
9	17		amended by adding Section 54.5192 to read as follows:
10	18		Sec. 54.5192. INTERCOLLEGIATE ATHLETICS FEE; UNIVERSITY OF
11	19		NORTH TEXAS AT DALLAS. (a) The board of regents of the University
12	20		of North Texas System may charge each student enrolled at the
13	21		University of North Texas at Dallas an intercollegiate athletics
14	22		fee in an initial amount not to exceed $10 per semester credit hour
15	23		for each regular semester or summer session. The amount of the fee
16	24		may be increased only as provided by Subsection (e).
17	25		(b) A student enrolled in more than 12 semester credit hours
18	26		shall pay the fee in an amount equal to the amount charged a student
19	27		enrolled in 12 semester credit hours during the same semester or
20	28		session.
21	29		(c) Revenue from the fee charged under this section may be
22	30		used only to develop and maintain an intercollegiate athletics
23	31		program at the university.
24	32		(d) The fee may not be charged unless approved by a majority
25	33		vote of the students enrolled at the university who participate in a
26	34		general student election held for that purpose.
27	35		(e) The amount of the fee per semester credit hour may be
28	36		increased from one academic year to the next only if approved by a
29	37		majority vote of the students participating in a general student
30	38		election held for that purpose or, if the amount of the increase
31	39		does not exceed five percent, by a majority vote of the legislative
32	40		body of the student government of the university.
33	41		(f) The ballot proposition for an election to approve a
34	42		proposed initial fee under Subsection (d) or a proposed fee
35	43		increase under Subsection (e) must:
36	44		(1) clearly state the amount of the proposed fee or fee
37	45		increase, as applicable; and
38	46		(2) describe the reason for the proposed fee or fee
39	47		increase, as applicable.
40	48		(g) A fee charged under this section is in addition to any
41	49		other fee authorized by law and may not be considered in determining
42	50		the maximum amount of student services fees that may be charged each
43	51		student enrolled at the university under Section 54.503.
44	52		SECTION 2. A fee may not be charged under Section 54.5192,
45	53		Education Code, as added by this Act, before the 2019 fall semester.
46	54		SECTION 3. This Act takes effect immediately if it receives
47	55		a vote of two-thirds of all the members elected to each house, as
48	56		provided by Section 39, Article III, Texas Constitution. If this
49	57		Act does not receive the vote necessary for immediate effect, this
50	58		Act takes effect September 1, 2019.
