67 AN ACT
78 relating to addressing adverse childhood experiences and
89 developing a strategic plan to address those experiences.
910 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1011 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1112 amended by adding Section 531.0222 to read as follows:
1213 Sec. 531.0222. COORDINATION TO ADDRESS ADVERSE CHILDHOOD
1314 EXPERIENCES; PROGRESS REPORT AND STRATEGIC PLAN. (a) In this
1415 section, "adverse childhood experience" includes:
1516 (1) abuse as defined by Section 261.001, Family Code;
1617 (2) neglect as defined by Section 261.001, Family
1718 Code;
1819 (3) family violence as defined by Section 71.004,
1920 Family Code;
2021 (4) death of a parent;
2122 (5) parental separation or divorce; and
2223 (6) substance use disorder, mental illness, or
2324 incarceration of a member of a child's household.
2425 (b) A program, service, or support established under this
2526 section may not include sex education.
2627 (c) In order to reduce exposure of children in this state to
2728 adverse childhood experiences and to address the social, health,
2829 and economic impacts of those experiences, the commission, in
2930 collaboration with the Department of Family and Protective
3031 Services, the Department of State Health Services, the Texas
3132 Education Agency, the Texas Workforce Commission, the office of the
3233 attorney general, the Texas Juvenile Justice Department, and an
3334 institution of higher education, as defined by Section 61.003,
3435 Education Code, with expertise in addressing adverse childhood
3536 experiences through a public health framework shall:
3637 (1) analyze data related to the causes and effects of
3738 adverse childhood experiences, including data from the Behavioral
3839 Risk Factor Surveillance System established by the Centers for
3940 Disease Control and Prevention of the United States Public Health
4041 Service;
4142 (2) evaluate prevention needs and gaps in services and
4243 support regarding awareness, assessments, and interventions
4344 addressing adverse childhood experiences;
4445 (3) identify methods to incorporate best practices for
4546 preventing and treating adverse childhood experiences into
4647 existing services and support programs offered for children and
4748 families; and
4849 (4) develop and implement a five-year strategic plan
4950 to prevent and address adverse childhood experiences.
5051 (d) In developing the five-year strategic plan under
5152 Subsection (c)(4), the commission may collaborate with
5253 representatives of:
5354 (1) state and local agencies and nonprofit
5455 organizations that work directly with children and families;
5556 (2) child welfare services providers;
5657 (3) early childhood education programs;
5758 (4) public schools;
5859 (5) medical and mental health services providers;
5960 (6) family support and social services providers;
6061 (7) the law enforcement, judicial, and criminal
6162 justice communities;
6263 (8) faith-based organizations;
63- (9) the intellectual or developmental disability
64- community;
65- (10) families and children impacted by adverse

67- (11) the business and philanthropic communities.

6867 (e) The strategic plan must incorporate a public health
6968 approach that promotes collaboration between agencies and
7069 community-based providers. The strategic plan may include
7170 strategies to:
7271 (1) train and educate professionals to assess,
7372 intervene, and prevent adverse childhood experiences;
7473 (2) provide trauma-informed practices for families,
7574 children, and providers impacted by adverse childhood experiences;
7675 (3) provide high quality child care;
7776 (4) provide support to parents to develop social and
7877 economic independence;
7978 (5) provide support to strengthen the engagement of
8079 fathers in their children's lives and establish paternity;
8180 (6) incorporate voluntary, evidence-based home
8281 visiting programs to strengthen families and to connect families to
8382 community resources;
8483 (7) develop parental support programs for teen parents
8584 and young mothers;
8685 (8) develop parental education training and
8786 counseling programs;
8887 (9) identify best practices for child protective
8988 services and investigations;
9089 (10) prevent and treat mental illness and substance
9190 use disorder;
92- (11) prevent
93- family violence; and
91+ (11) prevent intimate partner and family violence; and
9492 (12) prevent chronic diseases related to adverse
9593 childhood experiences.
9694 (f) The entities listed in Subsection (c) shall develop a
9795 community awareness approach to implement the strategies and
9896 recommendations in the strategic plan required under Subsection
9997 (c)(4).
10098 (g) The entities listed in Subsection (c) shall publish the
10199 five-year strategic plan required by Subsection (c)(4) on their
102100 respective Internet websites.
103101 SECTION 2. Not later than March 1, 2020, the Health and
104102 Human Services Commission shall develop a progress report to
105103 include data, best practices, and implementable changes within the
106104 commission's current capacity.
107105 SECTION 3. Not later than December 31, 2020, the Health and
108106 Human Services Commission shall:
109107 (1) develop the five-year strategic plan required by
110108 Section 531.0222(c)(4), Government Code, as added by this Act; and
111109 (2) submit a report to the Senate Health and Human
112110 Services Committee, the Senate Education Committee, the Senate
113111 Criminal Justice Committee, the House Public Education Committee,
114112 the House Juvenile Justice and Family Issues Committee, the House
115113 Public Health Committee, and the House Human Services Committee
116114 regarding the commission's strategies for preventing and treating
117115 adverse childhood experiences and any plan to incorporate those
118116 strategies into existing services and support programs for children
119117 and families.
120118 SECTION 4. This Act takes effect September 1, 2019.
