55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to suicide prevention in public school curriculum and
88 certain educational programs concerning suicide prevention and
99 substance abuse prevention.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 21.451(d), Education Code, is amended to
1212 read as follows:
1313 (d) The staff development:
1414 (1) may include training in:
1515 (A) technology;
1616 (B) conflict resolution;
1717 (C) discipline strategies, including classroom
1818 management, district discipline policies, and the student code of
1919 conduct adopted under Section 37.001 and Chapter 37;
2020 (D) preventing, identifying, responding to, and
2121 reporting incidents of bullying; and
2222 (E) digital learning;
2323 (2) subject to Subsection (e) and to Section 21.3541
2424 and rules adopted under that section, must include training that is
2525 evidence-based, as defined by Section 8101, Every Student Succeeds
2626 Act (20 U.S.C. Section 7801), that:
2727 (A) relates to instruction of students with
2828 disabilities; and
2929 (B) is designed for educators who work primarily
3030 outside the area of special education; and
3131 (3) must include suicide prevention training that must
3232 be provided:
3333 (A) on an annual basis, as part of a new employee
3434 orientation, to all new school district and open-enrollment charter
3535 school educators; and
3636 (B) to existing school district and
3737 open-enrollment charter school educators on a biennial basis
3838 [schedule adopted by the agency by rule].
3939 SECTION 2. Section 28.002, Education Code, is amended by
4040 amending Subsection (a) and adding Subsection (a-1) to read as
4141 follows:
4242 (a) Each school district that offers kindergarten through
4343 grade 12 shall offer, as a required curriculum:
4444 (1) a foundation curriculum that includes:
4545 (A) English language arts;
4646 (B) mathematics;
4747 (C) science; and
4848 (D) social studies, consisting of Texas, United
4949 States, and world history, government, economics, with emphasis on
5050 the free enterprise system and its benefits, and geography; and
5151 (2) an enrichment curriculum that includes:
5252 (A) to the extent possible, languages other than
5353 English;
5454 (B) health, with emphasis on:
5555 (i) physical health, including the
5656 importance of proper nutrition and exercise;
5757 (ii) mental health, including instruction
5858 on mental health conditions, substance abuse, skills to manage
5959 emotions, establishing and maintaining positive relationships, and
6060 responsible decision-making; and
6161 (iii) suicide prevention, including
6262 recognizing suicide-related risk factors and warning signs;
6363 (C) physical education;
6464 (D) fine arts;
6565 (E) career and technology education;
6666 (F) technology applications;
6767 (G) religious literature, including the Hebrew
6868 Scriptures (Old Testament) and New Testament, and its impact on
6969 history and literature; and
7070 (H) personal financial literacy.
7171 (a-1) In adopting the essential knowledge and skills for the
7272 health curriculum under Subsection (a)(2)(B), the State Board of
7373 Education shall adopt essential knowledge and skills that address:
7474 (1) the relationship between drug and alcohol use and
7575 suicide;
7676 (2) recognizing signs of suicidal tendencies and other
7777 warning signs of suicide; and
7878 (3) help-seeking behaviors and available community
7979 suicide prevention services.
8080 SECTION 3. Section 28.004, Education Code, is amended by
8181 amending Subsection (c) and adding Subsection (o) to read as
8282 follows:
8383 (c) The local school health advisory council's duties
8484 include recommending:
8585 (1) the number of hours of instruction to be provided
8686 in health education;
8787 (2) policies, procedures, strategies, and curriculum
8888 appropriate for specific grade levels designed to prevent obesity,
8989 cardiovascular disease, Type 2 diabetes, and mental health
9090 concerns, including suicide, through coordination of:
9191 (A) health education;
9292 (B) physical education and physical activity;
9393 (C) nutrition services;
9494 (D) parental involvement;
9595 (E) instruction to prevent the use of
9696 e-cigarettes, as defined by Section 161.081, Health and Safety
9797 Code, and tobacco;
9898 (F) school health services;
9999 (G) counseling and guidance services;
100100 (H) a safe and healthy school environment; and
101101 (I) school employee wellness;
102102 (3) appropriate grade levels and methods of
103103 instruction for human sexuality instruction;
104104 (4) strategies for integrating the curriculum
105105 components specified by Subdivision (2) with the following elements
106106 in a coordinated school health program for the district:
107107 (A) school health services;
108108 (B) counseling and guidance services;
109109 (C) a safe and healthy school environment; and
110110 (D) school employee wellness; and
111111 (5) if feasible, joint use agreements or strategies
112112 for collaboration between the school district and community
113113 organizations or agencies.
114114 (o) The local school health advisory council shall make
115115 policy recommendations to the district to increase parental
116116 awareness of suicide-related risk factors and warning signs and
117117 available community suicide prevention services.
118118 SECTION 4. Section 161.325(a-1), Health and Safety Code, as
119119 amended by Chapter 714 (H.B. 4056) and Chapter 522 (S.B. 179), Acts
120120 of the 85th Legislature, Regular Session, 2017, is reenacted and
121121 amended to read as follows:
122122 (a-1) The list must include programs and practices in the
123123 following areas:
124124 (1) early mental health prevention and intervention;
125125 (2) [mental health promotion;
126126 [(3)] substance abuse prevention and intervention;
127127 (3) [(4) substance abuse intervention;
128128 [(5)] suicide prevention, intervention, and
129129 postvention;
130130 (4) [(6)] grief-informed and trauma-informed
131131 practices;
132132 (5) [(7)] building skills related to managing
133133 emotions, establishing and maintaining positive relationships, and
134134 responsible decision-making;
135135 (6) [(8)] positive behavior interventions and
136136 supports and positive youth development; and
137137 (7) [(9)] safe, [and] supportive, and positive school
138138 climate.
139139 SECTION 5. Section 161.325, Health and Safety Code, is
140140 amended by adding Subsection (a-4) and amending Subsections (b) and
141141 (d) to read as follows:
142142 (a-4) In this section, "postvention" includes activities
143143 that promote healing necessary to reduce the risk of suicide by a
144144 person affected by the suicide of another.
145145 (b) The suicide prevention programs on the list must include
146146 components that provide for training counselors, teachers, nurses,
147147 administrators, and other staff, as well as law enforcement
148148 officers and social workers who regularly interact with students,
149149 to:
150150 (1) recognize students at risk of committing suicide,
151151 including students who are or may be the victims of or who engage in
152152 bullying;
153153 (2) recognize students displaying early warning signs
154154 and a possible need for early mental health or substance abuse
155155 intervention, which warning signs may include declining academic
156156 performance, depression, anxiety, isolation, unexplained changes
157157 in sleep or eating habits, and destructive behavior toward self and
158158 others; [and]
159159 (3) intervene effectively with students described by
160160 Subdivision (1) or (2) by providing notice and referral to a parent
161161 or guardian so appropriate action, such as seeking mental health or
162162 substance abuse services, may be taken by a parent or guardian; and
163163 (4) assist students in returning to school following
164164 treatment of a mental health concern or suicide attempt.
165165 (d) A school district shall [may] develop practices and
166166 procedures concerning each area listed in Subsection (a-1),
167167 including mental health promotion and intervention, substance
168168 abuse prevention and intervention, and suicide prevention, that:
169169 (1) include a procedure for providing notice of a
170170 recommendation for early mental health or substance abuse
171171 intervention regarding a student to a parent or guardian of the
172172 student within a reasonable amount of time after the identification
173173 of early warning signs as described by Subsection (b)(2);
174174 (2) include a procedure for providing notice of a
175175 student identified as at risk of committing suicide to a parent or
176176 guardian of the student within a reasonable amount of time after the
177177 identification of early warning signs as described by Subsection
178178 (b)(2);
179179 (3) establish that the district may develop a
180180 reporting mechanism and may designate at least one person to act as
181181 a liaison officer in the district for the purposes of identifying
182182 students in need of early mental health or substance abuse
183183 intervention or suicide prevention; [and]
184184 (4) set out available counseling alternatives for a
185185 parent or guardian to consider when their child is identified as
186186 possibly being in need of early mental health or substance abuse
187187 intervention or suicide prevention; and
188188 (5) include procedures:
189189 (A) to support the return of a student to school
190190 following hospitalization or residential treatment for a mental
191191 health condition or substance abuse; and
192192 (B) for suicide prevention, intervention, and
193193 postvention.
194194 SECTION 6. This Act takes effect September 1, 2019.
