55 AN ACT
66 relating to the definition of an authorized emergency vehicle.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 541.201, Transportation Code, is amended
99 by adding Subdivision (1)(L) to read as follow:
1010 (1) "Authorized emergency vehicle" means:
1111 (A) a fire department or police vehicle;
1212 (B) a public or private ambulance operated by a
1313 person who has been issued a license by the Department of State
1414 Health Services;
1515 (C) an emergency medical services vehicle:
1616 (i) authorized under an emergency medical
1717 services provider license issued by the Department of State Health
1818 Services under Chapter 773, Health and Safety Code; and
1919 (ii) operating under a contract with an
2020 emergency services district that requires the emergency medical
2121 services provider to respond to emergency calls with the vehicle;
2222 (D) a municipal department or public service
2323 corporation emergency vehicle that has been designated or
2424 authorized by the governing body of a municipality;
2525 (E) a county-owned or county-leased emergency
2626 management vehicle that has been designated or authorized by the
2727 commissioners court;
2828 (F) a vehicle that has been designated by the
2929 department under Section 546.0065;
3030 (G) a private vehicle of a volunteer firefighter
3131 or a certified emergency medical services employee or volunteer
3232 when responding to a fire alarm or medical emergency;
3333 (H) an industrial emergency response vehicle,
3434 including an industrial ambulance, when responding to an emergency,
3535 but only if the vehicle is operated in compliance with criteria in
3636 effect September 1, 1989, and established by the predecessor of the
3737 Texas Industrial Emergency Services Board of the State Firemen's
3838 and Fire Marshals' Association of Texas;
3939 (I) a vehicle of a blood bank or tissue bank,
4040 accredited or approved under the laws of this state or the United
4141 States, when making emergency deliveries of blood, drugs,
4242 medicines, or organs;
4343 (J) a vehicle used for law enforcement purposes
4444 that is owned or leased by a federal governmental entity; or
4545 (K) a private vehicle of an employee or volunteer
4646 of a county emergency management division in a county with a
4747 population of more than 46,500 and less than 48,000 that is
4848 designated as an authorized emergency vehicle by the commissioners
4949 court of that county.
5050 (L) a county road maintenance vehicle.
5151 SECTION 2. This Act takes effect immediately if it receives
5252 a vote of two-thirds of all the members elected to each house, as
5353 provided by Section 39, Article III, Texas Constitution. If this
5454 Act does not receive the vote necessary for immediate effect, this
5555 Act takes effect September 1, 2019.
