10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Subchapter C, Chapter 552, Government Code, is | |
12 | 12 | amended by adding Section 552.1315 to read as follows: | |
13 | 13 | Sec. 552.1315. EXCEPTION: CONFIDENTIALITY OF CERTAIN CRIME | |
14 | 14 | VICTIM RECORDS. Information maintained by a county or district | |
15 | 15 | clerk is confidential and not subject to disclosure under this | |
16 | 16 | chapter if the information identifies an individual as: | |
17 | 17 | (1) a victim of an offense under Section 22.011 or | |
18 | 18 | 22.021, Penal Code; or | |
19 | 19 | (2) a victim of any criminal offense, if the victim was | |
20 | 20 | younger than 17 years of age when any element of the offense was | |
21 | 21 | committed. | |
22 | 22 | SECTION 2. The change in law made by this Act applies to a | |
23 | 23 | request for information that is received by a governmental body or | |
24 | 24 | an officer for public information on or after the effective date of | |
25 | 25 | this Act. | |
26 | 26 | SECTION 3. This Act takes effect immediately if it receives | |
27 | 27 | a vote of two-thirds of all the members elected to each house, as | |
28 | 28 | provided by Section 39, Article III, Texas Constitution. If this | |
29 | 29 | Act does not receive the vote necessary for immediate effect, this | |
30 | 30 | Act takes effect September 1, 2019. |
