66 AN ACT
77 relating to an exception from required disclosure of information
88 related to certain crime victims maintained by a county or district
99 clerk.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 552, Government Code, is
1212 amended by adding Section 552.1315 to read as follows:
1313 Sec. 552.1315. EXCEPTION: CONFIDENTIALITY OF CERTAIN CRIME
1414 VICTIM RECORDS. Information maintained by a county or district
1515 clerk is confidential and not subject to disclosure under this
1616 chapter if the information identifies an individual as:
1717 (1) a victim of an offense under Section 22.011 or
1818 22.021, Penal Code; or
1919 (2) a victim of any criminal offense, if the victim was
2020 younger than 17 years of age when any element of the offense was
2121 committed.
2222 SECTION 2. The change in law made by this Act applies to a
2323 request for information that is received by a governmental body or
2424 an officer for public information on or after the effective date of
2525 this Act.
2626 SECTION 3. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2019.
