410 AN ACT
511 relating to accountability intervention provisions applicable to
612 school district campuses, including the conditions under which a
713 closed campus may be repurposed to serve students at that campus
814 location and the creation of accelerated campus excellence
915 turnaround plans.
1016 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1117 SECTION 1. Section 39A.105, Education Code, is amended to
1218 read as follows:
1319 Sec. 39A.105. CONTENTS OF CAMPUS TURNAROUND PLAN. (a) A
1420 campus turnaround plan must include:
1521 (1) details on the method for restructuring,
1622 reforming, or reconstituting the campus;
1723 (2) a detailed description of the academic programs to
1824 be offered at the campus, including:
1925 (A) instructional methods;
2026 (B) length of school day and school year;
2127 (C) academic credit and promotion criteria; and
2228 (D) programs to serve special student
2329 populations;
2430 (3) if a district charter is to be granted for the
2531 campus under Section 12.0522:
2632 (A) the term of the charter; and
2733 (B) information on the implementation of the
2834 charter;
2935 (4) written comments from:
3036 (A) the campus-level committee established under
3137 Section 11.251, if applicable;
3238 (B) parents; and
3339 (C) teachers at the campus; and
3440 (5) a detailed description of the budget, staffing,
3541 and financial resources required to implement the plan, including
3642 any supplemental resources to be provided by the school district or
3743 other identified sources.
3844 (b) A campus may submit an accelerated campus excellence
3945 turnaround plan as provided by this subsection. The plan must
4046 provide:
4147 (1) the assignment of a principal to the campus who has
4248 demonstrated a history of improvement in student academic growth at
4349 campuses in which the principal has previously worked;
4450 (2) that the principal has final authority over
4551 personnel decisions at the campus;
46- (3) that at least 60 percent of the classroom teachers
47- assigned to the campus be teachers who demonstrated instructional
48- effectiveness during the previous school year, with instructional
49- effectiveness determined by:
52+ (3) that at least 80 percent of the classroom teachers
53+ assigned to the campus be teachers who performed in the top quartile
54+ of teachers in the district that employed the teacher during the
55+ previous school year, with performance determined by:
5056 (A) for a teacher who taught in the district
5157 during the previous school year:
52- (i) the teacher's impact on student growth
53- as determined using a locally developed value-added model that
54- measures student performance on at least one assessment selected by
55- the district; and
58+ (i) the teacher's impact on student growth;
59+ and
5660 (ii) an evaluation of the teacher based on
5761 classroom observation; and
5862 (B) for a teacher who did not teach in the
5963 district during the previous school year, data and other evidence
6064 indicating that if the teacher had taught in the district during the
6165 previous school year, the teacher would have performed in the top
62- half of teachers in the district;
66+ quartile of teachers in the district;
6367 (4) a detailed description of the employment and
6468 compensation structures for the principal and classroom teachers,
6569 which must include:
6670 (A) significant incentives for a high-performing
6771 principal or teacher to remain at the campus; and
6872 (B) a three-year commitment by the district to
6973 continue incentives for the principal and teachers;
7074 (5) policies and procedures for the implementation of
7175 best practices at the campus, including:
7276 (A) data-driven instructional practices;
7377 (B) a system of observation of and feedback for
7478 classroom teachers;
7579 (C) positive student culture on the campus;
7680 (D) family and community engagement, including
77- partnerships with parent and community groups;
81+ partnerships with parent and community groups; and
7882 (E) extended learning opportunities for
7983 students, which may include service or workforce learning
8084 opportunities; and
81- (F) providing student services before or after
82- the instructional day that improve student performance, which may
83- include tutoring, extracurricular activities, counseling services,
84- and offering breakfast, lunch, and dinner to all students at the
85- campus; and
8685 (6) assistance by a third-party provider that is
8786 approved by the commissioner in the development and implementation
8887 of the district's plan.
8988 (c) The commissioner may provide guidance to districts as
9089 necessary to implement an accelerated campus excellence turnaround
9190 plan under Subsection (b).
9291 SECTION 2. Section 39A.107, Education Code, is amended by
9392 adding Subsection (a-3) to read as follows:
9493 (a-3) Notwithstanding Subsection (a), the commissioner
9594 shall approve a campus turnaround plan that the commissioner
9695 determines meets the requirements for an accelerated campus
9796 excellence turnaround plan under Section 39A.105(b).
9897 SECTION 3. Section 39A.113, Education Code, is amended by
9998 amending Subsections (a) and (b) and adding Subsection (a-1) to
10099 read as follows:
101100 (a) If the commissioner orders the closure of a campus under
102101 this subchapter, that campus may be repurposed to serve students at
103102 that campus location only if the commissioner:
104103 (1) finds that the repurposed campus [:
105104 [(A)] offers a distinctly different academic
106105 program[;] and:
107106 (A) [(B)] serves a majority of grade levels not
108107 served at the original campus; or [and]
109108 (B) is operated under a contract, approved by the
110109 school district board of trustees, with a nonprofit organization
111110 exempt from federal taxation under Section 501(c)(3), Internal
112111 Revenue Code of 1986, that:
113112 (i) has a governing board that is
114113 independent of the district;
115114 (ii) has a successful history of operating
116115 school district campuses or open-enrollment charter schools:
117116 (a) that cumulatively serve 10,000 or
118117 more students; and
119118 (b) a majority of which have been
120119 assigned an overall performance rating of B or higher under Section
121120 39.054 for the preceding school year; and
122121 (iii) has been assigned an overall
123122 performance rating of B or higher under Section 39.054 for the
124123 preceding school year; and
125124 (2) approves a new campus identification number for
126125 the repurposed campus.
127126 (a-1) A contract described by Subsection (a)(1)(B) must
128127 provide that a student residing in the attendance zone of the campus
129128 immediately before the campus was repurposed shall be admitted for
130129 enrollment at the repurposed campus.
131130 (b) The majority of students assigned to a campus that has
132131 been closed and repurposed under Subsection (a)(1)(A) may not have
133132 attended that campus in the previous school year.
134- SECTION 4. Subchapter C, Chapter 39A, Education Code, is
135- amended by adding Section 39A.116 to read as follows:
136- Sec. 39A.116. COMMISSIONER AUTHORITY. A decision by the
137- commissioner under this subchapter is final and may not be
138- appealed.
139- SECTION 5. (a) The commissioner of education shall select

143137 this Act, for the 2019-2020 school year. The commissioner may
144138 adjust timelines established under Chapter 39A, Education Code, for
145139 the campus selected by the commissioner under this section for
146140 purposes of developing and implementing the accelerated campus
147141 excellence turnaround plan. A decision by the commissioner under
148142 this section is final and may not be appealed.
149143 (b) Except as provided by Subsection (a), Sections 39A.105
150144 and 39A.107, Education Code, as amended by this Act, apply
151145 beginning with the 2020-2021 school year.
152- SECTION 6. This Act takes effect immediately if it receives

153147 a vote of two-thirds of all the members elected to each house, as
154148 provided by Section 39, Article III, Texas Constitution. If this
155149 Act does not receive the vote necessary for immediate effect, this
