55 AN ACT
66 relating to the establishment of a professional bee removal
77 training and licensure program.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 71, Agriculture Code, is amended by
1010 adding Sec. 71.155 to read as follows:
1111 Sec. 71.155. Training OF BEE REMOVAL PROFESSIONALS: (a)
1212 The department by rule shall establish the requirements for a bee
1313 removal professional training program. Additionally, the
1414 individual (to acquire said license, and or certificate would carry
1515 insurance in the amount of $600,000.00 aggregate and $300,000.00
1616 per incident (+) workman's comp at his own expense.
1717 (b) The training program must include:
1818 (1) at least 80 hours of classroom instruction and 80
1919 hours of practical instruction in the areas of:
2020 (2) honey bees;
2121 (3) beekeeping; and
2222 (4) non lethal removal of bees from a structure; and
2323 (5) a comprehensive final examination.
2424 (c) The department by rule shall establish the minimum
2525 passing score for the final examination.
2626 (d) The department shall approve one or more organizations
2727 to provide the bee removal professional training program.
2828 SECTION 2. Chapter 71, Agriculture Code, is amended by
2929 adding Sec. 71.156 to read as follows:
3030 Sec. 71.156. ISSUANCE OF CERTIFICATE OR LICENSE. The
3131 department shall issue a bee removal professional certificate to a
3232 person who:
3333 (e) applies to the department;
3434 (f) successfully completes the bee removal professional
3535 training program under Section 71.155; and
3636 (g) pays the required fee.
3737 SECTION 3. Subchapter B, Chapter 1951, Occupations Code, is
3838 amended by adding Section 1951.604 to read as follows:
3939 (h) Sec. 1951.604. BEE REMOVAL PROFESSIONALS. (a) Except
4040 as provided by Sections 1951.212 and 1951.457(c), this chapter does
4141 not apply to a person who:
4242 (i) holds a bee removal professional certificate issued
4343 under Chapter 71.155, Agriculture Code;
4444 (j) does not use pesticides; and
4545 (k) collects and removes honeybees.
4646 (l) (b) A person described by Subsection (a) is not
4747 considered to be engaged in the business of structural pest
4848 control.
4949 (m) must include:
5050 (1) at least 80 hours of classroom instruction and 80
5151 hours of practical instruction in the areas of:
5252 (A) honey bees;
5353 (B) beekeeping; and non lethal removal of bees
5454 from a structure; and
5555 (2) a comprehensive final examination.
5656 (n) The department by rule shall establish the minimum
5757 passing score for the final examination.
5858 (o) The department shall approve one or more organizations
5959 to provide the bee removal professional training program.
6060 SECTION 4. Not later than March 1, 2020, the Department of
6161 Agriculture shall adopt rules under Section 71.155, Agriculture
6262 Code, as added by this Act, and approve one or more organizations to
6363 provide the bee removal professional training program under that
6464 section.
6565 SECTION 5. This Act takes effect immediately if it receives
6666 a vote of two-thirds of all the members elected to each house, as
6767 provided by Section 39, Article III, Texas Constitution. If this
6868 Act does not receive the vote necessary for immediate effect, this
6969 Act takes effect January 1, 2020.
