55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the applicability of certain public works contracting
88 requirements to a metropolitan rapid transit authority.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 451, Transportation Code,
1111 is amended by adding Section 451.1111 to read as follows:
1212 Sec. 451.1111. EXEMPTION FROM OTHER CONTRACTING LAW.
1313 Chapter 2269, Government Code, does not apply to an authority. An
1414 authority may adopt design-build procedures that do not materially
1515 conflict with Subchapter H, Chapter 2269, Government Code.
1616 SECTION 2. Section 2269.353(b), Government Code, is amended
1717 to read as follows:
1818 (b) A contract for a project under this subchapter may cover
1919 only a single integrated project. A governmental entity may not
2020 enter into a contract for aggregated projects at multiple
2121 locations. For purposes of this subsection,[:
2222 [(1) if a metropolitan transit authority created under
2323 Chapter 451, Transportation Code, enters into a contract for a
2424 project involving a linear transit project with multiple stops
2525 along the project route for boarding passengers, created under
2626 Chapter 451, Transportation Code, the linear transit project is a
2727 single integrated project; and
2828 [(2)] a water treatment plant, including a
2929 desalination plant, that includes treatment facilities, well
3030 fields, and pipelines is a single integrated project.
3131 SECTION 3. This Act takes effect September 1, 2019.
