| 9 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 12 | | SECTION 1. Subchapter D, Chapter 1579, Insurance Code, is |

| 11 | 13 | | amended by adding Section 1579.156 to read as follows: |

| 12 | 14 | | Sec. 1579.156. PARTICIPATION BY MUNICIPAL SCHOOL DISTRICT. |

| 13 | 15 | | (a) A municipal school district, as described by Section 11.303, |
|---|
| 14 | 16 | | Education Code, that was operating on January 1, 2019, may: |
|---|
| 15 | 17 | | (1) elect to participate in the program; or |
|---|
| 16 | 18 | | (2) notwithstanding any previous election or |
|---|
| 17 | 19 | | requirement to participate in the program, provide health coverage |
|---|
| 18 | 20 | | to the district's employees through the health coverage plan |
|---|
| 19 | 21 | | provided to the employees of the municipality in which the district |
|---|
| 20 | 22 | | is located. |
|---|
| 21 | 23 | | (b) If a municipal school district that participates in the |
|---|
| 22 | 24 | | program elects to provide health coverage under Subsection (a)(2), |
|---|
| 23 | 25 | | the municipal school district shall withdraw from the program by |
|---|
| 24 | 26 | | notifying the trustee in writing that the district is withdrawing |
|---|
| 25 | 27 | | from the program. |
|---|
| 26 | 28 | | SECTION 2. This Act takes effect September 1, 2019. |
