55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the criminal offense of stalking.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 42.072(a), Penal Code, is amended to
1010 read as follows:
1111 (a) A person commits an offense if the person, on more than
1212 one occasion and pursuant to the same scheme or course of conduct
1313 that is directed specifically at the victim [another person],
1414 knowingly engages in conduct that:
1515 (1) constitutes an offense under Section 42.07, or
1616 that the actor knows or reasonably should know the victim [other
1717 person] will regard as threatening:
1818 (A) bodily injury or death for the victim [other
1919 person];
2020 (B) bodily injury or death for:
2121 (i) a member of the victim's [other
2222 person's] family or household; or
2323 (ii) [for] an individual with whom the
2424 victim [other person] has a dating relationship; or
2525 (C) that an offense will be committed against the
2626 victim's [other person's] property;
2727 (2) causes the victim [other person], a member of the
2828 victim's [other person's] family or household, or an individual
2929 with whom the victim [other person] has a dating relationship:
3030 (A) to be placed in fear of bodily injury or death
3131 or [in fear] that an offense will be committed against the victim's
3232 [other person's] property;[,] or
3333 (B) to feel harassed, annoyed, alarmed, abused,
3434 tormented, embarrassed, or offended; and
3535 (3) would cause a reasonable person to:
3636 (A) fear bodily injury or death for himself or
3737 herself;
3838 (B) fear bodily injury or death for:
3939 (i) a member of the person's family or
4040 household; or
4141 (ii) [for] an individual with whom the
4242 person has a dating relationship;
4343 (C) fear that an offense will be committed
4444 against the person's property; or
4545 (D) feel harassed, annoyed, alarmed, abused,
4646 tormented, embarrassed, or offended.
4747 SECTION 2. The change in law made by this Act applies only
4848 to an offense committed on or after the effective date of this Act.
4949 An offense committed before the effective date of this Act is
5050 governed by the law in effect on the date the offense was committed,
5151 and the former law is continued in effect for that purpose. For
5252 purposes of this section, an offense was committed before the
5353 effective date of this Act if any element of the offense occurred
5454 before that date.
5555 SECTION 3. This Act takes effect September 1, 2019.
