| 7 | 7 | | relating to the provision of informational materials and certain |

| 8 | 8 | | other information to a pregnant woman before an abortion. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 171.012, Health and Safety Code, is |
|---|
| 11 | 11 | | amended by amending Subsection (b) and adding Subsection (f) to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (b) The information required to be provided under |
|---|
| 14 | 14 | | Subsections (a)(1) and (2) may not be provided by audio or video |
|---|
| 15 | 15 | | recording and must be provided at least 24 hours before the abortion |
|---|
| 16 | 16 | | is to be performed: |
|---|
| 17 | 17 | | (1) orally and in person in a private and confidential |
|---|
| 18 | 18 | | setting if the pregnant woman currently lives less than 100 miles |
|---|
| 19 | 19 | | from the nearest abortion provider that is a facility licensed |
|---|
| 20 | 20 | | under Chapter 245 or a facility that performs more than 50 abortions |
|---|
| 21 | 21 | | in any 12-month period; or |
|---|
| 22 | 22 | | (2) orally by telephone on a private call or in person |
|---|
| 23 | 23 | | in a private and confidential setting if the pregnant woman |
|---|
| 24 | 24 | | certifies that the woman currently lives 100 miles or more from the |
|---|
| 25 | 25 | | nearest abortion provider that is a facility licensed under Chapter |
|---|
| 26 | 26 | | 245 or a facility that performs more than 50 abortions in any |
|---|
| 27 | 27 | | 12-month period. |
|---|
| 28 | 28 | | (f) The physician who is to perform the abortion shall in |
|---|
| 29 | 29 | | person provide a copy of the informational materials described by |
|---|
| 30 | 30 | | Section 171.014: |
|---|
| 31 | 31 | | (1) on the day of the consultation required under |
|---|
| 32 | 32 | | Subsection (a)(4) for a pregnant woman who lives less than 100 miles |
|---|
| 33 | 33 | | from the nearest abortion provider that is a facility licensed |
|---|
| 34 | 34 | | under Chapter 245 or a facility that performs more than 50 abortions |
|---|
| 35 | 35 | | in any 12-month period; or |
|---|
| 36 | 36 | | (2) before any sedative or anesthesia is administered |
|---|
| 37 | 37 | | to the pregnant woman on the day of the abortion and at least two |
|---|
| 38 | 38 | | hours before the abortion if the woman lives 100 miles or more from |
|---|
| 39 | 39 | | the nearest abortion provider that is a facility licensed under |
|---|
| 40 | 40 | | Chapter 245 or a facility that performs more than 50 abortions in |
|---|
| 41 | 41 | | any 12-month period. |
|---|
| 42 | 42 | | SECTION 2. Section 171.012, Health and Safety Code, as |
|---|
| 43 | 43 | | amended by this Act, applies only to an abortion performed on or |
|---|
| 44 | 44 | | after the effective date of this Act. |
|---|
| 45 | 45 | | SECTION 3. This Act takes effect September 1, 2019. |
