9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to retaliation for municipal annexation disapproval.
612 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
713 SECTION 1. Section 43.0688, Local Government Code, is
814 amended by amending Subsection (a) and adding Subsection (c) to
915 read as follows:
1016 (a) The disapproval of the proposed annexation of an area
1117 under this subchapter does not affect any existing legal obligation
1218 of the municipality proposing the annexation to continue to provide
1319 governmental services in the area, including water or wastewater
1420 services, regardless of whether the municipality holds a
1521 certificate of convenience and necessity to serve the area.
1622 (c) A municipality that makes a wholesale sale of water to a
1723 special district operating under Chapter 36 or Title 4, Water Code,
1824 may not charge rates for the water that are higher than rates
1925 charged in other similarly situated areas solely because the
2026 district is wholly or partly located in an area that disapproved of
2127 a proposed annexation under this subchapter.
2228 SECTION 2. Section 43.0699, Local Government Code, is
2329 amended by amending Subsection (a) and adding Subsection (c) to
2430 read as follows:
2531 (a) The disapproval of the proposed annexation of an area
2632 under this subchapter does not affect any existing legal obligation
2733 of the municipality proposing the annexation to continue to provide
2834 governmental services in the area, including water or wastewater
2935 services, regardless of whether the municipality holds a
3036 certificate of convenience and necessity to serve the area.
3137 (c) A municipality that makes a wholesale sale of water to a
3238 special district operating under Chapter 36 or Title 4, Water Code,
3339 may not charge rates for the water that are higher than rates
3440 charged in other similarly situated areas solely because the
3541 district is wholly or partly located in an area that disapproved of
3642 a proposed annexation under this subchapter.
3743 SECTION 3. This Act takes effect immediately if it receives
3844 a vote of two-thirds of all the members elected to each house, as
3945 provided by Section 39, Article III, Texas Constitution. If this
4046 Act does not receive the vote necessary for immediate effect, this
4147 Act takes effect September 1, 2019.
