55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to developing a strategic plan to ensure the provision of
88 prevention and early intervention services complies with federal
99 law.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 265, Family Code, is
1212 amended by adding Section 265.0051 to read as follows:
1313 Sec. 265.0051. STRATEGIC PLAN REGARDING FEDERAL FAMILY
1414 FIRST PREVENTION SERVICES ACT. (a) The department shall develop a
1515 strategic plan to ensure that the provision of prevention and early
1616 intervention services meets the requirements of the federal Family
1717 First Prevention Services Act (Title VII, Div. E, Pub. L.
1818 No. 115-123).
1919 (b) The strategic plan required under this section must:
2020 (1) identify for federal approval a network of
2121 prevention and early intervention services providers to provide
2222 mental health, substance use, and in-home parenting support
2323 services for:
2424 (A) children at risk of entering foster care;
2525 (B) the parents and caregivers of children
2626 identified under Paragraph (A); and
2727 (C) pregnant or parenting youth in foster care;
2828 (2) identify methods to:
2929 (A) maximize resources from the federal
3030 government under the federal Family First Prevention Services Act
3131 (Title VII, Div. E, Pub. L. No. 115-123);
3232 (B) apply for other available federal and private
3333 funds;
3434 (C) streamline and reduce duplication of effort
3535 by each state agency involved in providing prevention and early
3636 intervention services; and
3737 (D) streamline the procedures for determining
3838 eligibility for prevention and early intervention services;
3939 (3) include a method to:
4040 (A) notify the Senate Health and Human Services
4141 Committee, the Senate Finance Committee, the House Committee on
4242 Human Services, the House Committee on Public Health, and the House
4343 Appropriations Committee of federal and private funding
4444 opportunities; and
4545 (B) respond to the opportunities described by
4646 Paragraph (A); and
4747 (4) identify opportunities to coordinate with
4848 independent researchers to assist community programs in evaluating
4949 and developing trauma-informed services and promising, supported,
5050 or well-supported services and strategies under the federal Family
5151 First Prevention Services Act (Title VII, Div. E, Pub. L.
5252 No. 115-123).
5353 (c) In developing the network of providers described by
5454 Subsection (b)(1), the department shall consult with the Health and
5555 Human Services Commission, the Department of State Health Services,
5656 and community stakeholders.
5757 (d) In developing the procedure described by Subsection
5858 (b)(2), the department shall consult with the Health and Human
5959 Services Commission and the Department of State Health Services.
6060 (e) This section expires March 1, 2021.
6161 SECTION 2. Not later than September 1, 2020, the Department
6262 of Family and Protective Services shall make the plan required by
6363 Section 265.0051, Family Code, as added by this Act, available to
6464 the Senate Health and Human Services Committee, the Senate Finance
6565 Committee, the House Committee on Human Services, the House
6666 Committee on Public Health, and the House Appropriations Committee.
6767 SECTION 3. This Act takes effect September 1, 2019.
