55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the imposition of a time payment fee on certain persons
88 convicted of a criminal offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 102.0212, Government Code, is amended to
1111 read as follows:
1212 Sec. 102.0212. COURT COSTS ON CONVICTION: LOCAL GOVERNMENT
1313 CODE. A person convicted of an offense shall pay the following
1414 under the Local Government Code, in addition to all other costs:
1515 (1) court costs on conviction of a felony (Sec.
1616 133.102, Local Government Code) . . . $133;
1717 (2) court costs on conviction of a Class A or Class B
1818 misdemeanor (Sec. 133.102, Local Government Code) . . . $83;
1919 (3) court costs on conviction of a nonjailable
2020 misdemeanor offense, including a criminal violation of a municipal
2121 ordinance, other than a conviction of an offense relating to a
2222 pedestrian or the parking of a motor vehicle (Sec. 133.102, Local
2323 Government Code) . . . $40;
2424 (4) a time payment fee if convicted of a felony or
2525 misdemeanor for paying any part of a fine, court costs, or
2626 restitution on or after the 61st [31st] day after the date on which
2727 a judgment is entered assessing the fine, court costs, or
2828 restitution (Sec. 133.103, Local Government Code) . . . $25;
2929 (5) a cost on conviction of any offense, other than an
3030 offense relating to a pedestrian or the parking of a motor vehicle
3131 (Sec. 133.105, Local Government Code) . . . $6; and
3232 (6) a cost on conviction of any offense, other than an
3333 offense relating to a pedestrian or the parking of a motor vehicle
3434 (Sec. 133.107, Local Government Code) . . . $2.
3535 SECTION 2. Section 133.103(a), Local Government Code, is
3636 amended to read as follows:
3737 (a) A person convicted of an offense shall pay, in addition
3838 to all other costs, a fee of $25 if the person:
3939 (1) has been convicted of a felony or misdemeanor; and
4040 (2) pays any part of a fine, court costs, or
4141 restitution on or after the 61st [31st] day after the date on which
4242 a judgment is entered assessing the fine, court costs, or
4343 restitution.
4444 SECTION 3. The change in law made by this Act applies only
4545 to an offense committed on or after the effective date of this Act.
4646 An offense committed before the effective date of this Act is
4747 governed by the law in effect when the offense was committed, and
4848 the former law is continued in effect for that purpose. For
4949 purposes of this section, an offense was committed before the
5050 effective date of this Act if any element of the offense occurred
5151 before that date.
5252 SECTION 4. This Act takes effect September 1, 2019.
