| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 102.0212, Government Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | Sec. 102.0212. COURT COSTS ON CONVICTION: LOCAL GOVERNMENT |
|---|
| 13 | 13 | | CODE. A person convicted of an offense shall pay the following |
|---|
| 14 | 14 | | under the Local Government Code, in addition to all other costs: |
|---|
| 15 | 15 | | (1) court costs on conviction of a felony (Sec. |
|---|
| 16 | 16 | | 133.102, Local Government Code) . . . $133; |
|---|
| 17 | 17 | | (2) court costs on conviction of a Class A or Class B |
|---|
| 18 | 18 | | misdemeanor (Sec. 133.102, Local Government Code) . . . $83; |
|---|
| 19 | 19 | | (3) court costs on conviction of a nonjailable |
|---|
| 20 | 20 | | misdemeanor offense, including a criminal violation of a municipal |
|---|
| 21 | 21 | | ordinance, other than a conviction of an offense relating to a |
|---|
| 22 | 22 | | pedestrian or the parking of a motor vehicle (Sec. 133.102, Local |
|---|
| 23 | 23 | | Government Code) . . . $40; |
|---|
| 24 | 24 | | (4) a time payment fee if convicted of a felony or |
|---|
| 25 | 25 | | misdemeanor for paying any part of a fine, court costs, or |
|---|
| 26 | 26 | | restitution on or after the 61st [31st] day after the date on which |

| 27 | 27 | | a judgment is entered assessing the fine, court costs, or |
|---|
| 28 | 28 | | restitution (Sec. 133.103, Local Government Code) . . . $25; |

| 29 | 29 | | (5) a cost on conviction of any offense, other than an |
|---|
| 30 | 30 | | offense relating to a pedestrian or the parking of a motor vehicle |

| 35 | 35 | | SECTION 2. Section 133.103(a), Local Government Code, is |
|---|
| 36 | 36 | | amended to read as follows: |
|---|
| 37 | 37 | | (a) A person convicted of an offense shall pay, in addition |
|---|
| 38 | 38 | | to all other costs, a fee of $25 if the person: |
|---|
| 39 | 39 | | (1) has been convicted of a felony or misdemeanor; and |
|---|
| 40 | 40 | | (2) pays any part of a fine, court costs, or |
|---|
| 41 | 41 | | restitution on or after the 61st [31st] day after the date on which |
|---|
| 42 | 42 | | a judgment is entered assessing the fine, court costs, or |
|---|
| 43 | 43 | | restitution. |

| 44 | 44 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 45 | 45 | | to an offense committed on or after the effective date of this Act. |
|---|
| 46 | 46 | | An offense committed before the effective date of this Act is |
|---|
| 47 | 47 | | governed by the law in effect when the offense was committed, and |
|---|
| 48 | 48 | | the former law is continued in effect for that purpose. For |
|---|
| 49 | 49 | | purposes of this section, an offense was committed before the |
|---|
| 50 | 50 | | effective date of this Act if any element of the offense occurred |
|---|
| 51 | 51 | | before that date. |
|---|
| 52 | 52 | | SECTION 4. This Act takes effect September 1, 2019. |
