66 AN ACT
77 relating to Medicaid coverage of doula services.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 32.024, Human Resources Code, is amended
1010 by adding Subsection (nn) to read as follows:
1111 (nn) The commission shall provide medical assistance
1212 reimbursement for services provided by a doula, including
1313 childbirth education and emotional and physical support provided
1414 during pregnancy, labor, birth, and the postpartum period. The
1515 executive commissioner by rule shall determine the doula services
1616 to be covered and any doula certification requirements.
1717 SECTION 2. Not later than December 1, 2019, the executive
1818 commissioner of the Health and Human Services Commission shall
1919 adopt the rules necessary to implement Section 32.024(nn), Human
2020 Resources Code, as added by this Act.
2121 SECTION 3. If before implementing any provision of this Act
2222 a state agency determines that an additional waiver or additional
2323 authorization from a federal agency is necessary for implementation
2424 of that provision, the agency affected by the provision shall
2525 request the waiver or authorization and may delay implementing that
2626 provision until the waiver or authorization is granted.
2727 SECTION 4. This Act takes effect September 1, 2019.
