7 | 7 | | relating to Medicaid coverage of doula services. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 32.024, Human Resources Code, is amended |
---|
10 | 10 | | by adding Subsection (nn) to read as follows: |
---|
11 | 11 | | (nn) The commission shall provide medical assistance |
---|
12 | 12 | | reimbursement for services provided by a doula, including |
---|
13 | 13 | | childbirth education and emotional and physical support provided |
---|
14 | 14 | | during pregnancy, labor, birth, and the postpartum period. The |
---|
15 | 15 | | executive commissioner by rule shall determine the doula services |
---|
16 | 16 | | to be covered and any doula certification requirements. |
---|
17 | 17 | | SECTION 2. Not later than December 1, 2019, the executive |
---|
18 | 18 | | commissioner of the Health and Human Services Commission shall |
---|
19 | 19 | | adopt the rules necessary to implement Section 32.024(nn), Human |
---|
20 | 20 | | Resources Code, as added by this Act. |
---|
21 | 21 | | SECTION 3. If before implementing any provision of this Act |
---|
22 | 22 | | a state agency determines that an additional waiver or additional |
---|
23 | 23 | | authorization from a federal agency is necessary for implementation |
---|
24 | 24 | | of that provision, the agency affected by the provision shall |
---|
25 | 25 | | request the waiver or authorization and may delay implementing that |
---|
26 | 26 | | provision until the waiver or authorization is granted. |
---|
27 | 27 | | SECTION 4. This Act takes effect September 1, 2019. |
